8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Chapter 773, Health and Safety Code, is amended |
---|
10 | 10 | | by adding Subchapter I to read as follows: |
---|
11 | 11 | | SUBCHAPTER I. EMERGENCY MEDICAL AIR TRANSPORTATION FUNDING |
---|
12 | 12 | | Sec. 773.221. DEFINITIONS. In this subchapter: |
---|
13 | 13 | | (1) "Account" means the emergency medical air |
---|
14 | 14 | | transportation account created under Section 773.222. |
---|
15 | 15 | | (2) "Commission" means the Health and Human Services |
---|
16 | 16 | | Commission. |
---|
17 | 17 | | (3) "Commissioner" means the commissioner of state |
---|
18 | 18 | | health services. |
---|
19 | 19 | | Sec. 773.222. EMERGENCY MEDICAL AIR TRANSPORTATION |
---|
20 | 20 | | ACCOUNT. (a) The emergency medical air transportation account is |
---|
21 | 21 | | established as a dedicated account in the general revenue fund. The |
---|
22 | 22 | | account is composed of: |
---|
23 | 23 | | (1) money deposited to the credit of the account under |
---|
24 | 24 | | Section 542.4031, Transportation Code; and |
---|
25 | 25 | | (2) notwithstanding Section 404.071, Government Code, |
---|
26 | 26 | | interest earned on the investment of money in the account and |
---|
27 | 27 | | depository interest allocable to the account. |
---|
28 | 28 | | (b) Money in the account may be appropriated only to the |
---|
29 | 29 | | department for the purposes described by Subsection (c). |
---|
30 | 30 | | (c) The commissioner may: |
---|
31 | 31 | | (1) use the money appropriated from the account to |
---|
32 | 32 | | fund emergency medical air transportation; and |
---|
33 | 33 | | (2) after consulting with the executive commissioner, |
---|
34 | 34 | | transfer the money appropriated from the account to the commission |
---|
35 | 35 | | to: |
---|
36 | 36 | | (A) provide reimbursements under the medical |
---|
37 | 37 | | assistance program under Chapter 32, Human Resources Code, to |
---|
38 | 38 | | providers of emergency medical air transportation services, |
---|
39 | 39 | | including reimbursement enhancements to the statewide dollar |
---|
40 | 40 | | amount rate used to reimburse designated air ambulance services |
---|
41 | 41 | | under the program; and |
---|
42 | 42 | | (B) maximize the receipt of federal funds under |
---|
43 | 43 | | the medical assistance program under Chapter 32, Human Resources |
---|
44 | 44 | | Code. |
---|
45 | 45 | | SECTION 2. Section 542.4031(g), Transportation Code, is |
---|
46 | 46 | | amended to read as follows: |
---|
47 | 47 | | (g) Of the money received by the comptroller under this |
---|
48 | 48 | | section, the comptroller shall deposit: |
---|
49 | 49 | | (1) 67 percent to the credit of the undedicated |
---|
50 | 50 | | portion of the general revenue fund; [and] |
---|
51 | 51 | | (2) 16.5 [33] percent to the credit of the designated |
---|
52 | 52 | | trauma facility and emergency medical services account under |
---|
53 | 53 | | Section 780.003, Health and Safety Code; and |
---|
54 | 54 | | (3) 16.5 percent to the credit of the designated |
---|
55 | 55 | | emergency medical air transportation account under Section |
---|
56 | 56 | | 773.222, Health and Safety Code. |
---|
57 | 57 | | SECTION 3. Section 542.4031(g), Transportation Code, as |
---|
58 | 58 | | amended by this Act, applies only to the distribution of revenue |
---|
59 | 59 | | collected on or after the effective date of this Act. The |
---|
60 | 60 | | distribution of revenue collected before the effective date of this |
---|
61 | 61 | | Act is governed by the law in effect at the time the revenue was |
---|
62 | 62 | | collected, and that law is continued in effect for the purpose of |
---|
63 | 63 | | the distribution of that revenue. |
---|
64 | 64 | | SECTION 4. This Act takes effect September 1, 2015. |
