77 relating to emergency medical air transportation funding.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 773, Health and Safety Code, is amended
1010 by adding Subchapter I to read as follows:
1111 SUBCHAPTER I. EMERGENCY MEDICAL AIR TRANSPORTATION FUNDING
1212 Sec. 773.221. DEFINITIONS. In this subchapter:
1313 (1) "Account" means the emergency medical air
1414 transportation account created under Section 773.222.
1515 (2) "Commission" means the Health and Human Services
1616 Commission.
1717 (3) "Commissioner" means the commissioner of state
1818 health services.
1919 Sec. 773.222. EMERGENCY MEDICAL AIR TRANSPORTATION
2020 ACCOUNT. (a) The emergency medical air transportation account is
2121 established as a dedicated account in the general revenue fund. The
2222 account is composed of:
2323 (1) money deposited to the credit of the account under
2424 Section 542.4031, Transportation Code; and
2525 (2) notwithstanding Section 404.071, Government Code,
2626 interest earned on the investment of money in the account and
2727 depository interest allocable to the account.
2828 (b) Money in the account may be appropriated only to the
2929 department for the purposes described by Subsection (c).
3030 (c) The commissioner may:
3131 (1) use the money appropriated from the account to
3232 fund emergency medical air transportation; and
3333 (2) after consulting with the executive commissioner,
3434 transfer the money appropriated from the account to the commission
3535 to:
3636 (A) provide reimbursements under the medical
3737 assistance program under Chapter 32, Human Resources Code, to
3838 providers of emergency medical air transportation services,
3939 including reimbursement enhancements to the statewide dollar
4040 amount rate used to reimburse designated air ambulance services
4141 under the program; and
4242 (B) maximize the receipt of federal funds under
4343 the medical assistance program under Chapter 32, Human Resources
4444 Code.
4545 SECTION 2. Section 542.4031(g), Transportation Code, is
4646 amended to read as follows:
4747 (g) Of the money received by the comptroller under this
4848 section, the comptroller shall deposit:
4949 (1) 67 percent to the credit of the undedicated
5050 portion of the general revenue fund; [and]
5151 (2) 16.5 [33] percent to the credit of the designated
5252 trauma facility and emergency medical services account under
5353 Section 780.003, Health and Safety Code; and
5454 (3) 16.5 percent to the credit of the designated
5555 emergency medical air transportation account under Section
5656 773.222, Health and Safety Code.
5757 SECTION 3. Section 542.4031(g), Transportation Code, as
5858 amended by this Act, applies only to the distribution of revenue
5959 collected on or after the effective date of this Act. The
6060 distribution of revenue collected before the effective date of this
6161 Act is governed by the law in effect at the time the revenue was
6262 collected, and that law is continued in effect for the purpose of
6363 the distribution of that revenue.
6464 SECTION 4. This Act takes effect September 1, 2015.
