66 AN ACT
77 relating to the establishment of limited purpose public junior
88 college districts by certain independent school districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 130.011, Education Code, is amended by
1111 adding Subsection (c) to read as follows:
1212 (c) An independent school district located in a county with
1313 a population of less than 45,000 that does not meet the scholastic
1414 population requirements of Section 130.032 may establish a limited
1515 purpose junior college district under this subchapter to meet the
1616 career and technical interests of students and employers in the
1717 district. A limited purpose junior college district is not
1818 required to provide the programs described by Section
1919 130.003(e)(4), (5), or (8).
2020 SECTION 2. Section 130.017, Education Code, is amended by
2121 adding Subsection (e) to read as follows:
2222 (e) For a limited purpose junior college district
2323 established under Section 130.011(c), the proposition described by
2424 Subsection (b) must provide that the junior college district may
2525 not levy ad valorem taxes at a rate that, when combined with the
2626 rate charged by the independent school district, exceeds the rate
2727 charged by the independent school district before the board of
2828 trustees divested its authority as governing board of the junior
2929 college district.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2015.
