| 8 | 8 | | college districts by certain independent school districts. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 130.011, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (c) to read as follows: |
|---|
| 12 | 12 | | (c) An independent school district located in a county with |
|---|
| 13 | 13 | | a population of less than 45,000 that does not meet the scholastic |
|---|
| 14 | 14 | | population requirements of Section 130.032 may establish a limited |
|---|
| 15 | 15 | | purpose junior college district under this subchapter to meet the |
|---|
| 16 | 16 | | career and technical interests of students and employers in the |
|---|
| 17 | 17 | | district. A limited purpose junior college district is not |
|---|
| 18 | 18 | | required to provide the programs described by Section |
|---|
| 19 | 19 | | 130.003(e)(4), (5), or (8). |
|---|
| 20 | 20 | | SECTION 2. Section 130.017, Education Code, is amended by |
|---|
| 21 | 21 | | adding Subsection (e) to read as follows: |
|---|
| 22 | 22 | | (e) For a limited purpose junior college district |
|---|
| 23 | 23 | | established under Section 130.011(c), the proposition described by |
|---|
| 24 | 24 | | Subsection (b) must provide that the junior college district may |
|---|
| 25 | 25 | | not levy ad valorem taxes at a rate that, when combined with the |
|---|
| 26 | 26 | | rate charged by the independent school district, exceeds the rate |
|---|
| 27 | 27 | | charged by the independent school district before the board of |
|---|
| 28 | 28 | | trustees divested its authority as governing board of the junior |
|---|
| 29 | 29 | | college district. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2015. |
