44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the calculation of a service retirement annuity for
77 certain members of the elected class.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 814.103, Government Code, is amended by
1010 amending Subsection (a) and adding Subsection (c) to read as
1111 follows:
1212 (a) Except as provided by Subsections [Subsection] (b) and
1313 (c), the standard service retirement annuity for service credited
1414 in the elected class of membership for persons described by Section
1515 812.002(a)(3), is an amount equal to the number of years of service
1616 credit in that class, times two percent of the state salary,
1717 excluding longevity pay payable under Section 659.0445, and as
1818 adjusted from time to time, being paid a district judge.
1919 (c) The standard service retirement annuity for service
2020 credited in the elected class of membership for persons described
2121 by Sections 812.002(a)(1) and (2) is an amount equal to the number
2222 of years of service credit in that class, times two percent of the
2323 state salary, as that salary existed on August 31st, 2015 and
2424 excluding longevity pay payable under Section 659.0445, being paid
2525 a district judge.
2626 SECTION 2. The change in law made by Sections 814.103(a) and
2727 (c), Government Code, as amended by this Act, applies only to a
2828 person who retires from the elected class on or after September 1,
2929 2015. A person who retires from the elected class before that date
3030 is governed by the law in effect on the date that person retired,
3131 and the former law is continued in effect for that purpose.
3232 SECTION 3. This Act takes effect September 1, 2015.
