6 | 6 | | relating to the calculation of a service retirement annuity for |

7 | 7 | | certain members of the elected class. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 814.103, Government Code, is amended by |
---|
10 | 10 | | amending Subsection (a) and adding Subsection (c) to read as |
---|
11 | 11 | | follows: |
---|
12 | 12 | | (a) Except as provided by Subsections [Subsection] (b) and |
---|
13 | 13 | | (c), the standard service retirement annuity for service credited |
---|
14 | 14 | | in the elected class of membership for persons described by Section |
---|
15 | 15 | | 812.002(a)(3), is an amount equal to the number of years of service |
---|
16 | 16 | | credit in that class, times two percent of the state salary, |
---|
17 | 17 | | excluding longevity pay payable under Section 659.0445, and as |
---|
18 | 18 | | adjusted from time to time, being paid a district judge. |
---|
19 | 19 | | (c) The standard service retirement annuity for service |
---|
20 | 20 | | credited in the elected class of membership for persons described |
---|
21 | 21 | | by Sections 812.002(a)(1) and (2) is an amount equal to the number |
---|
22 | 22 | | of years of service credit in that class, times two percent of the |
---|
23 | 23 | | state salary, as that salary existed on August 31st, 2015 and |
---|
24 | 24 | | excluding longevity pay payable under Section 659.0445, being paid |
---|
25 | 25 | | a district judge. |

26 | 26 | | SECTION 2. The change in law made by Sections 814.103(a) and |
---|
27 | 27 | | (c), Government Code, as amended by this Act, applies only to a |
---|
28 | 28 | | person who retires from the elected class on or after September 1, |
---|
29 | 29 | | 2015. A person who retires from the elected class before that date |
---|
30 | 30 | | is governed by the law in effect on the date that person retired, |
---|
31 | 31 | | and the former law is continued in effect for that purpose. |
---|
32 | 32 | | SECTION 3. This Act takes effect September 1, 2015. |
