99 relating to the creation and regulation of a law enforcement agency
1010 or police department.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1701.163, Occupations Code, is amended
1313 by adding Subsection (c) to read as follows:
1414 (c) The entity may not begin operation of the law
1515 enforcement agency or police department unless:
1616 (1) the entity submits all of the information required
1717 under Subsection (b) to the commission; and
1818 (2) the commission issues the entity an agency number
1919 for the law enforcement agency or police department.
2020 SECTION 2. Subchapter D, Chapter 1701, Occupations Code, is
2121 amended by adding Section 1701.1631 to read as follows:
2222 Sec. 1701.1631. SUSPENSION OF OPERATIONS OF CERTAIN
2323 AGENCIES OR DEPARTMENTS. The commission may suspend the operations
2424 of a law enforcement agency or police department described by
2525 Section 1701.163 if the entity creating the law enforcement agency
2626 or police department:
2727 (1) cannot demonstrate an ongoing need for the law
2828 enforcement agency or police department in the community;
2929 (2) does not maintain or provide adequate physical
3030 facilities for the law enforcement agency or police department,
3131 including an adequate evidence room, dispatch area, and public
3232 area;
3333 (3) does not maintain or enforce adequate law
3434 enforcement policies for the law enforcement agency or police
3535 department, including policies on:
3636 (A) use of force;
3737 (B) vehicle pursuit;
3838 (C) professional conduct of officers;
3939 (D) domestic abuse protocols;
4040 (E) response to missing persons;
4141 (F) supervision of part-time officers; and
4242 (G) impartial policing;
4343 (4) does not have an effective administrative
4444 structure for the law enforcement agency or police department; or
4545 (5) does not maintain adequate liability insurance for
4646 the law enforcement agency or police department.
4747 SECTION 3. This Act takes effect September 1, 2015.
