66 AN ACT
77 relating to the authority of a county or municipality to enforce a
88 smoking ban on the premises of certain businesses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 161.089, Health and Safety Code, is
1111 amended to read as follows:
1212 Sec. 161.089. PREEMPTION OF LOCAL LAW; EXCEPTION. (a)
1313 Except as provided by Subsection (b), this [This] subchapter does
1414 not preempt a local regulation of the sale, distribution, or use of
1515 cigarettes or tobacco products or affect the authority of a
1616 political subdivision to adopt or enforce an ordinance or
1717 requirement relating to the sale, distribution, or use of
1818 cigarettes or tobacco products if the regulation, ordinance, or
1919 requirement:
2020 (1) is compatible with and equal to or more stringent
2121 than a requirement prescribed by this subchapter; or
2222 (2) relates to an issue that is not specifically
2323 addressed by this subchapter or Chapter 154 or 155, Tax Code.
2424 (b) A county or municipality may not enforce an order,
2525 ordinance, or similar measure to prohibit smoking on the premises
2626 of a business which allows smoking and for which at least 20 percent
2727 of the business's revenue is derived from the sale of cigars or
2828 other tobacco products.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2015.
