| 7 | 7 | | municipal building and standards commission. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter C, Chapter 54, Local Government Code, |
|---|
| 10 | 10 | | is amended to read as follows: |
|---|
| 11 | 11 | | Sec. 54.036. FUNCTIONS. A commission panel may: |
|---|
| 12 | 12 | | (1) order the repair, within a fixed period, of buildings |
|---|
| 13 | 13 | | found to be in violation of an ordinance; |
|---|
| 14 | 14 | | (2) declare a building substandard in accordance with the |
|---|
| 15 | 15 | | powers granted by this subchapter; |
|---|
| 16 | 16 | | (3) order, in an appropriate case, the immediate removal of |
|---|
| 17 | 17 | | persons or property found on private property, enter on private |
|---|
| 18 | 18 | | property to secure the removal if it is determined that conditions |
|---|
| 19 | 19 | | exist on the property that constitute a violation of an ordinance, |
|---|
| 20 | 20 | | and order action to be taken as necessary to remedy, alleviate, or |
|---|
| 21 | 21 | | remove any substandard building found to exist; |
|---|
| 22 | 22 | | (4) issue orders or directives to any peace officer of the |
|---|
| 23 | 23 | | state, including a sheriff or constable or the chief of police of |
|---|
| 24 | 24 | | the municipality, to enforce and carry out the lawful orders or |
|---|
| 25 | 25 | | directives of the commission panel; |
|---|
| 26 | 26 | | (5) determine the amount and duration of the civil penalty |
|---|
| 27 | 27 | | the municipality may recover as provided by Section 54.017; |
|---|
| 28 | 28 | | (6) order action to be taken as necessary to remedy, |
|---|
| 29 | 29 | | alleviate, remove, or abate, violations of ordinances relating to |
|---|
| 30 | 30 | | animal care and control or water conservation measures, including |
|---|
| 31 | 31 | | water restrictions. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2015. |
