44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to additional functions of a commission panel of a
77 municipal building and standards commission.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 54, Local Government Code,
1010 is amended to read as follows:
1111 Sec. 54.036. FUNCTIONS. A commission panel may:
1212 (1) order the repair, within a fixed period, of buildings
1313 found to be in violation of an ordinance;
1414 (2) declare a building substandard in accordance with the
1515 powers granted by this subchapter;
1616 (3) order, in an appropriate case, the immediate removal of
1717 persons or property found on private property, enter on private
1818 property to secure the removal if it is determined that conditions
1919 exist on the property that constitute a violation of an ordinance,
2020 and order action to be taken as necessary to remedy, alleviate, or
2121 remove any substandard building found to exist;
2222 (4) issue orders or directives to any peace officer of the
2323 state, including a sheriff or constable or the chief of police of
2424 the municipality, to enforce and carry out the lawful orders or
2525 directives of the commission panel;
2626 (5) determine the amount and duration of the civil penalty
2727 the municipality may recover as provided by Section 54.017;
2828 (6) order action to be taken as necessary to remedy,
2929 alleviate, remove, or abate, violations of ordinances relating to
3030 animal care and control or water conservation measures, including
3131 water restrictions.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2015.
