44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the County Court of Cooke County.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sec. 26.149, Government Code, is amended to read
99 as follows:
1010 (a) The County Court of Cooke County does not have probate,
1111 guardianship, mental health, juvenile, civil, criminal, or
1212 appellate jurisdiction.
1313 (b) The judge of the County Court of Cooke County retains
1414 the ability to act as a magistrate as defined under Art 2.09 of the
1515 Code of Criminal Procedure [is exempt from the judicial training
1616 and instruction required under Chapter 22].
1717 SECTION 2. This act takes effect immediately if it receives
1818 a vote of two-thirds of all the members elected to each house, as
1919 provided by Section 39, Article III, Texas Constitution. If this
2020 act does not receive the vote necessary for immediate effect, this
2121 act takes effect September 1, 2015.
