9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 8 | | SECTION 1. Section 74.101, Property Code, is amended by |
---|
11 | 9 | | adding Subsection (e) to read as follows: |
---|
12 | 10 | | (e) A holder of mineral proceeds under Chapter 75 that is |
---|
13 | 11 | | regulated by the Railroad Commission of Texas under Chapter 91, |
---|
14 | 12 | | Natural Resources Code, shall include in the property report for |
---|
15 | 13 | | the proceeds, in addition to the information listed in Subsection |
---|
16 | 14 | | (c), the following information with respect to each well the |
---|
17 | 15 | | production from which resulted in the proceeds: |
---|
18 | 16 | | (1) the lease, property, or well name; |
---|
19 | 17 | | (2) any lease, property, or well identification number |
---|
20 | 18 | | used to identify the lease, property, or well; and |
---|
21 | 19 | | (3) the county in which the lease, property, or well is |
---|
22 | 20 | | located. |
---|
23 | 21 | | SECTION 2. The heading to Section 74.104, Property Code, is |
---|
24 | 22 | | amended to read as follows: |
---|
25 | 23 | | Sec. 74.104. CONFIDENTIALITY OF PROPERTY REPORT; |
---|
26 | 24 | | EXCEPTIONS. |
---|
27 | 25 | | SECTION 3. Section 74.104, Property Code, is amended by |
---|
28 | 26 | | amending Subsection (a) and adding Subsections (c), (d), and (e) to |
---|
29 | 27 | | read as follows: |
---|
30 | 28 | | (a) Except as provided by Subsection (c) and Section 74.201, |
---|
31 | 29 | | 74.203, or 74.307, a property report filed with the comptroller |
---|
32 | 30 | | under Section 74.101 is confidential until the second anniversary |
---|
33 | 31 | | of the date the report is filed. |
---|
34 | 32 | | (c) The information reported under Section 74.101(e) is |
---|
35 | 33 | | confidential and not subject to disclosure under Chapter 552, |
---|
36 | 34 | | Government Code. |
---|
37 | 35 | | (d) Notwithstanding Subsection (c), the comptroller may |
---|
38 | 36 | | release the information about a well reported under Section |
---|
39 | 37 | | 74.101(e) to a claimant of mineral proceeds from the well if the |
---|
40 | 38 | | claim is approved by the comptroller under Section 74.501. |
---|
41 | 39 | | (e) Notwithstanding Subsection (c), the information |
---|
42 | 40 | | compiled under Section 74.307(a)(2) is subject to disclosure under |
---|
43 | 41 | | Chapter 552, Government Code. |
---|
44 | 42 | | SECTION 4. Section 74.307, Property Code, is amended to |
---|
45 | 43 | | read as follows: |
---|
46 | 44 | | Sec. 74.307. LIST OF OWNERS; OTHER PUBLIC INFORMATION. |
---|
47 | 45 | | (a) The comptroller shall compile and revise each year: |
---|
48 | 46 | | (1) [,] except as to amounts reported in the |
---|
49 | 47 | | aggregate, an alphabetical list of the names and last known |
---|
50 | 48 | | addresses of the owners listed in the reports and the amount |
---|
51 | 49 | | credited to each account; and |
---|
52 | 50 | | (2) an alphabetical list by county of: |
---|
53 | 51 | | (A) the number of reports filed under Section |
---|
54 | 52 | | 74.101 for mineral proceeds attributable to all wells located in |
---|
55 | 53 | | each respective county; and |
---|
56 | 54 | | (B) the aggregate amount of mineral proceeds |
---|
57 | 55 | | reported under Section 74.101 attributable to all wells, if any, |
---|
58 | 56 | | located in each respective county. |
---|
59 | 57 | | (b) The comptroller shall make the lists [list] available |
---|
60 | 58 | | for public inspection during all reasonable business hours. |
---|
61 | 59 | | SECTION 5. Section 74.101(e), Property Code, as added by |
---|
62 | 60 | | this Act, applies only to a report filed on or after the effective |
---|
63 | 61 | | date of this Act. A report filed before the effective date of this |
---|
64 | 62 | | Act is governed by the law as it existed immediately before the |
---|
65 | 63 | | effective date of this Act, and that law is continued in effect for |
---|
66 | 64 | | that purpose. |
---|
67 | 65 | | SECTION 6. This Act takes effect January 1, 2016. |
---|
