95 A BILL TO BE ENTITLED
106 AN ACT
117 relating to certification requirements for teachers in bilingual
128 education.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. Section 29.061, Education Code, is amended by
1511 amending Subsections (b) and (c) and adding Subsections (b-1) and
1612 (b-2) to read as follows:
1713 (b) A teacher assigned to a bilingual education program
1814 using one of the following program models must be appropriately
1915 certified for bilingual education by the board:
2016 (1) transitional bilingual/early exit program model;
2117 or
2218 (2) transitional bilingual/late exit program model.
2319 (b-1) A teacher assigned to a bilingual education program
2420 using a dual language immersion/one-way or two-way program model
2521 must be appropriately certified by the board for:
2622 (1) bilingual education for the component of the
2723 program provided in a language other than English; and
2824 (2) bilingual education or English as a second
2925 language for the component of the program provided in English.
3026 (b-2) A school district that provides a bilingual education
3127 program using a dual language immersion/one-way or two-way program
3228 model may assign a teacher certified under Subsection (b-1)(1) for
3329 the language other than English component of the program and a
3430 different teacher certified under Subsection (b-1)(2) for the
3531 English language component.
3632 (c) A teacher assigned to an English as a second language
3733 [or other special language] program must be appropriately certified
3834 for English as a second language by the board.
3935 SECTION 2. This Act applies beginning with the 2015-2016
4036 school year.
4137 SECTION 3. This Act takes effect immediately if it receives
4238 a vote of two-thirds of all the members elected to each house, as
4339 provided by Section 39, Article III, Texas Constitution. If this
4440 Act does not receive the vote necessary for immediate effect, this
4541 Act takes effect September 1, 2015.
