| 13 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 10 | | SECTION 1. Section 29.061, Education Code, is amended by |
|---|
| 15 | 11 | | amending Subsections (b) and (c) and adding Subsections (b-1) and |
|---|
| 16 | 12 | | (b-2) to read as follows: |
|---|
| 17 | 13 | | (b) A teacher assigned to a bilingual education program |
|---|
| 18 | 14 | | using one of the following program models must be appropriately |
|---|
| 19 | 15 | | certified for bilingual education by the board: |
|---|
| 20 | 16 | | (1) transitional bilingual/early exit program model; |
|---|
| 21 | 17 | | or |
|---|
| 22 | 18 | | (2) transitional bilingual/late exit program model. |
|---|
| 23 | 19 | | (b-1) A teacher assigned to a bilingual education program |
|---|
| 24 | 20 | | using a dual language immersion/one-way or two-way program model |
|---|
| 25 | 21 | | must be appropriately certified by the board for: |
|---|
| 26 | 22 | | (1) bilingual education for the component of the |
|---|
| 27 | 23 | | program provided in a language other than English; and |
|---|
| 28 | 24 | | (2) bilingual education or English as a second |
|---|
| 29 | 25 | | language for the component of the program provided in English. |
|---|
| 30 | 26 | | (b-2) A school district that provides a bilingual education |
|---|
| 31 | 27 | | program using a dual language immersion/one-way or two-way program |
|---|
| 32 | 28 | | model may assign a teacher certified under Subsection (b-1)(1) for |
|---|
| 33 | 29 | | the language other than English component of the program and a |
|---|
| 34 | 30 | | different teacher certified under Subsection (b-1)(2) for the |
|---|
| 35 | 31 | | English language component. |
|---|
| 36 | 32 | | (c) A teacher assigned to an English as a second language |

| 37 | 33 | | [or other special language] program must be appropriately certified |
|---|
| 38 | 34 | | for English as a second language by the board. |
|---|
| 39 | 35 | | SECTION 2. This Act applies beginning with the 2015-2016 |
|---|
| 40 | 36 | | school year. |

| 41 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 42 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 41 | | Act takes effect September 1, 2015. |
