99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to authorizing certain private schools to charge fees for
1212 processing or handling certain payments or payment transactions.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subtitle C, Title 5, Business & Commerce Code, is
1515 amended by adding Chapter 111 to read as follows:
1616 CHAPTER 111. PRIVATE SCHOOLS
1717 Sec. 111.001. DEFINITIONS. In this chapter:
1818 (1) "Cardholder" means the person named on the face of
1919 a credit or debit card to whom or for whose benefit the card is
2020 issued.
2121 (2) "Credit card" means a card or device issued under
2222 an agreement by which the issuer gives to a cardholder the right to
2323 obtain credit from the issuer or another person.
2424 (3) "Debit card" has the meaning assigned by Section
2525 502.001.
2626 (4) "Private school" means a school that:
2727 (A) offers a course of instruction for students
2828 in one or more grades from prekindergarten through grade 12;
2929 (B) is not operated by a governmental entity; and
3030 (C) is accredited by an accrediting agency that
3131 is a member of the Texas Private School Accreditation Commission.
3232 Sec. 111.002. CHARGES AND FEES FOR CERTAIN PAYMENTS AT
3333 PRIVATE SCHOOLS. (a) This section applies to a payment of
3434 tuition, a fee, or another charge to a private school that is made
3535 or authorized in person, by mail, by telephone call, or through the
3636 Internet by means of:
3737 (1) a credit card;
3838 (2) a debit card; or
3939 (3) an electronic funds transfer.
4040 (b) A private school may charge a fee or other amount in
4141 connection with a payment to which this section applies, in
4242 addition to the amount of the tuition, fee, or other charge being
4343 paid, including:
4444 (1) a discount, convenience, or service charge for the
4545 transaction; or
4646 (2) a service charge in connection with a payment
4747 transaction that is dishonored or refused for lack of funds or
4848 insufficient funds.
4949 (c) A fee or other charge under this section must be in an
5050 amount reasonable and necessary to reimburse the school for the
5151 expense incurred by the school in processing and handling the
5252 payment or payment transaction.
5353 (d) Before accepting a payment by credit card, debit card,
5454 or electronic funds transfer, the school shall notify the
5555 cardholder or other person making the payment of any fee to be
5656 charged under this section.
5757 SECTION 2. Section 59.402(b), Finance Code, is amended to
5858 read as follows:
5959 (b) This section does not apply to:
6060 (1) a state agency, county, local governmental entity,
6161 or other governmental entity that accepts a debit or stored value
6262 card for the payment of fees, taxes, or other charges; or
6363 (2) a private school that accepts a debit card for the
6464 payment of fees or other charges, as provided by Section 111.002,
6565 Business & Commerce Code.
6666 SECTION 3. Section 339.001(b), Finance Code, is amended to
6767 read as follows:
6868 (b) This section does not apply to:
6969 (1) a state agency, county, local governmental entity,
7070 or other governmental entity that accepts a credit card for the
7171 payment of fees, taxes, or other charges; or
7272 (2) a private school that accepts a credit card for the
7373 payment of fees or other charges, as provided by Section 111.002,
7474 Business & Commerce Code.
7575 SECTION 4. This Act takes effect immediately if it receives
7676 a vote of two-thirds of all the members elected to each house, as
7777 provided by Section 39, Article III, Texas Constitution. If this
7878 Act does not receive the vote necessary for immediate effect, this
7979 Act takes effect September 1, 2015.
