55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the delivery of certain Medicaid managed care benefits
88 and reimbursement rates for certain of those services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 533.00251(c) and (d), Government Code,
1111 are amended to read as follows:
1212 (c) Subject to Section 533.0025 and notwithstanding any
1313 other law, the commission, in consultation with the advisory
1414 committee, shall provide benefits under the medical assistance
1515 program to recipients who reside in nursing facilities through the
1616 STAR + PLUS Medicaid managed care program. In implementing this
1717 subsection, the commission shall ensure:
1818 (1) that, subject to Section 533.002511, the
1919 commission is responsible for setting the minimum reimbursement
2020 rate paid to a nursing facility under the managed care program,
2121 including the staff rate enhancement paid to a nursing facility
2222 that qualifies for the enhancement;
2323 (2) that a nursing facility is paid not later than the
2424 10th day after the date the facility submits a clean claim;
2525 (3) the appropriate utilization of services
2626 consistent with criteria adopted by the commission;
2727 (4) a reduction in the incidence of potentially
2828 preventable events and unnecessary institutionalizations;
2929 (5) that a managed care organization providing
3030 services under the managed care program provides discharge
3131 planning, transitional care, and other education programs to
3232 physicians and hospitals regarding all available long-term care
3333 settings;
3434 (6) that a managed care organization providing
3535 services under the managed care program:
3636 (A) assists in collecting applied income from
3737 recipients; and
3838 (B) provides payment incentives to nursing
3939 facility providers that reward reductions in preventable acute care
4040 costs and encourage transformative efforts in the delivery of
4141 nursing facility services, including efforts to promote a
4242 resident-centered care culture through facility design and
4343 services provided;
4444 (7) the establishment of a portal that is in
4545 compliance with state and federal regulations, including standard
4646 coding requirements, through which nursing facility providers
4747 participating in the STAR + PLUS Medicaid managed care program may
4848 submit claims to any participating managed care organization;
4949 (8) that rules and procedures relating to the
5050 certification and decertification of nursing facility beds under
5151 the medical assistance program are not affected; and
5252 (9) that a managed care organization providing
5353 services under the managed care program, to the greatest extent
5454 possible, offers nursing facility providers access to:
5555 (A) acute care professionals; and
5656 (B) telemedicine, when feasible and in
5757 accordance with state law, including rules adopted by the Texas
5858 Medical Board.
5959 (d) Subject to Subsection (e), the commission shall ensure
6060 that a nursing facility provider authorized to provide services
6161 under the medical assistance program on September 1, 2015 [2013],
6262 is allowed to participate in the STAR + PLUS Medicaid managed care
6363 program through August 31, 2019 [2017].
6464 SECTION 2. Subchapter A, Chapter 533, Government Code, is
6565 amended by adding Section 533.002511 to read as follows:
6666 Sec. 533.002511. MINIMUM NURSING FACILITY REIMBURSEMENT
6767 RATES FOR RECIPIENTS ALSO ELIGIBLE FOR MEDICARE. A contract
6868 between a managed care organization and the commission for the
6969 organization to provide health care services to recipients must
7070 contain a requirement that the minimum reimbursement rate paid by
7171 the organization to a nursing facility for services provided to a
7272 recipient who is also eligible to receive services under the
7373 Medicare program is the prevailing reimbursement rate for nursing
7474 facilities under the Medicare program.
7575 SECTION 3. Section 533.005(a-1), Government Code, is
7676 amended to read as follows:
7777 (a-1) The requirements imposed by Subsections (a)(23)(A),
7878 (B), and (C) do not apply, and may not be enforced, on and after
7979 August 31, 2019 [2018].
8080 SECTION 4. If before implementing any provision of this Act
8181 a state agency determines that a waiver or authorization from a
8282 federal agency is necessary for implementation of that provision,
8383 the agency affected by the provision shall request the waiver or
8484 authorization and may delay implementing that provision until the
8585 waiver or authorization is granted.
8686 SECTION 5. This Act takes effect immediately if it receives
8787 a vote of two-thirds of all the members elected to each house, as
8888 provided by Section 39, Article III, Texas Constitution. If this
8989 Act does not receive the vote necessary for immediate effect, this
9090 Act takes effect September 1, 2015.
