55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a limitation on the amount of school property tax
88 revenue that is subject to recapture under the public school
99 finance system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 41.002, Education Code, is amended by
1212 adding Subsections (c), (d), and (d-1) to read as follows:
1313 (c) Notwithstanding any other provision of this chapter and
1414 except as provided by Subsection (d), if the difference between a
1515 school district's wealth per student and the equalized wealth level
1616 is greater than the difference between the school district's wealth
1717 per student for the 2014-2015 school year and the equalized wealth
1818 level for the 2014-2015 school year, the commissioner shall
1919 consider the school district to have reduced its wealth per student
2020 to an amount equal to the equalized wealth level plus the difference
2121 between the school district's wealth per student for the 2014-2015
2222 school year and the equalized wealth level for the 2014-2015 school
2323 year. This subsection applies only to a school district that, in
2424 the 2014-2015 school year, had a wealth per student that exceeded
2525 the equalized wealth level of that school year.
2626 (d) Notwithstanding any other provision of this chapter, if
2727 the difference between a school district's wealth per student,
2828 including any reduction under Subsection (c), and the equalized
2929 wealth level is greater than the difference between the school
3030 district's wealth per student, including any reduction under
3131 Subsection (c) or this subsection, for the preceding school year
3232 and the equalized wealth level for that school year, the
3333 commissioner shall consider the school district's wealth per
3434 student to be an amount equal to the lesser of:
3535 (1) the school district's wealth per student,
3636 including any reduction under Subsection (c); or
3737 (2) the equalized wealth level, plus the product of:
3838 (A) the difference between the wealth per
3939 student, including any reduction under Subsection (c) or this
4040 subsection, for the preceding school year and the equalized wealth
4141 level for that school year; and
4242 (B) the quotient, if greater than or equal to
4343 one, of the number of students enrolled in all public schools in
4444 this state for the current year, as determined by the commissioner,
4545 divided by the number of students enrolled in all public schools in
4646 this state for the preceding year, as determined by the
4747 commissioner. If this quotient is less than one, the commissioner
4848 shall determine the school district's wealth per student under
4949 Subdivision (1).
5050 (d-1) Subsection (d) applies only to a school district that,
5151 in the preceding school year, had a wealth per student that exceeded
5252 the equalized wealth level of that school year.
5353 SECTION 2. This Act takes effect September 1, 2015.
