10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 41.002, Education Code, is amended by |
---|
12 | 12 | | adding Subsections (c), (d), and (d-1) to read as follows: |
---|
13 | 13 | | (c) Notwithstanding any other provision of this chapter and |
---|
14 | 14 | | except as provided by Subsection (d), if the difference between a |
---|
15 | 15 | | school district's wealth per student and the equalized wealth level |
---|
16 | 16 | | is greater than the difference between the school district's wealth |
---|
17 | 17 | | per student for the 2014-2015 school year and the equalized wealth |
---|
18 | 18 | | level for the 2014-2015 school year, the commissioner shall |
---|
19 | 19 | | consider the school district to have reduced its wealth per student |
---|
20 | 20 | | to an amount equal to the equalized wealth level plus the difference |
---|
21 | 21 | | between the school district's wealth per student for the 2014-2015 |
---|
22 | 22 | | school year and the equalized wealth level for the 2014-2015 school |
---|
23 | 23 | | year. This subsection applies only to a school district that, in |
---|
24 | 24 | | the 2014-2015 school year, had a wealth per student that exceeded |
---|
25 | 25 | | the equalized wealth level of that school year. |
---|
26 | 26 | | (d) Notwithstanding any other provision of this chapter, if |
---|
27 | 27 | | the difference between a school district's wealth per student, |
---|
28 | 28 | | including any reduction under Subsection (c), and the equalized |
---|
29 | 29 | | wealth level is greater than the difference between the school |
---|
30 | 30 | | district's wealth per student, including any reduction under |
---|
31 | 31 | | Subsection (c) or this subsection, for the preceding school year |
---|
32 | 32 | | and the equalized wealth level for that school year, the |
---|
33 | 33 | | commissioner shall consider the school district's wealth per |
---|
34 | 34 | | student to be an amount equal to the lesser of: |
---|
35 | 35 | | (1) the school district's wealth per student, |
---|
36 | 36 | | including any reduction under Subsection (c); or |
---|
37 | 37 | | (2) the equalized wealth level, plus the product of: |
---|
38 | 38 | | (A) the difference between the wealth per |
---|
39 | 39 | | student, including any reduction under Subsection (c) or this |
---|
40 | 40 | | subsection, for the preceding school year and the equalized wealth |
---|
41 | 41 | | level for that school year; and |
---|
42 | 42 | | (B) the quotient, if greater than or equal to |
---|
43 | 43 | | one, of the number of students enrolled in all public schools in |
---|
44 | 44 | | this state for the current year, as determined by the commissioner, |
---|
45 | 45 | | divided by the number of students enrolled in all public schools in |
---|
46 | 46 | | this state for the preceding year, as determined by the |
---|
47 | 47 | | commissioner. If this quotient is less than one, the commissioner |
---|
48 | 48 | | shall determine the school district's wealth per student under |
---|
49 | 49 | | Subdivision (1). |
---|
50 | 50 | | (d-1) Subsection (d) applies only to a school district that, |
---|
51 | 51 | | in the preceding school year, had a wealth per student that exceeded |
---|
52 | 52 | | the equalized wealth level of that school year. |
---|
53 | 53 | | SECTION 2. This Act takes effect September 1, 2015. |
