55 AN ACT
66 relating to longevity pay for certain state employees.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 659.042, Government Code, is amended to
99 read as follows:
1010 Sec. 659.042. EXCLUSIONS. The following are not entitled
1111 to longevity pay under this subchapter:
1212 (1) a member of the legislature;
1313 (2) an individual who holds a statewide office that is
1414 normally filled by vote of the people, except as provided by Section
1515 659.0445;
1616 (3) an independent contractor or an employee of an
1717 independent contractor;
1818 (4) a temporary employee;
1919 (5) an officer or employee of a public junior college;
2020 (6) an academic employee of a state institution of
2121 higher education; [or]
2222 (7) a state employee who retired from state employment
2323 on or after June 1, 2005, and who receives an annuity based wholly
2424 or partly on service as a state officer or state employee in a
2525 public retirement system, as defined by Section 802.001, that was
2626 credited to the state employee; or
2727 (8) a state employee who first begins state employment
2828 on or after September 1, 2015.
2929 SECTION 2. This Act takes effect September 1, 2015.
