7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Section 659.042, Government Code, is amended to | |
9 | 9 | read as follows: | |
10 | 10 | Sec. 659.042. EXCLUSIONS. The following are not entitled | |
11 | 11 | to longevity pay under this subchapter: | |
12 | 12 | (1) a member of the legislature; | |
13 | 13 | (2) an individual who holds a statewide office that is | |
14 | 14 | normally filled by vote of the people, except as provided by Section | |
15 | 15 | 659.0445; | |
16 | 16 | (3) an independent contractor or an employee of an | |
17 | 17 | independent contractor; | |
18 | 18 | (4) a temporary employee; | |
19 | 19 | (5) an officer or employee of a public junior college; | |
20 | 20 | (6) an academic employee of a state institution of | |
21 | 21 | higher education; [or] | |
22 | 22 | (7) a state employee who retired from state employment | |
23 | 23 | on or after June 1, 2005, and who receives an annuity based wholly | |
24 | 24 | or partly on service as a state officer or state employee in a | |
25 | 25 | public retirement system, as defined by Section 802.001, that was | |
26 | 26 | credited to the state employee; or | |
27 | 27 | (8) a state employee who first begins state employment | |
28 | 28 | on or after September 1, 2015. | |
29 | 29 | SECTION 2. This Act takes effect September 1, 2015. |
