66 AN ACT
77 relating to municipal regulation of passenger transportation for
88 compensation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 215.004, Local Government
1111 Code, is amended to read as follows:
1212 Sec. 215.004. PASSENGER TRANSPORTATION SERVICES FOR
1313 COMPENSATION [TAXICABS AND LIMOUSINES].
1414 SECTION 2. Sections 215.004(a), (a-1), (b), and (c), Local
1515 Government Code, are amended to read as follows:
1616 (a) To protect the public health, safety, and welfare, a
1717 municipality by ordinance:
1818 (1) except as provided by Subdivision (2), shall
1919 license, control, and otherwise regulate each private passenger
2020 vehicle, regardless of how it is propelled, that provides passenger
2121 [taxicab] transportation services for compensation and is designed
2222 for carrying no more than eight passengers; and
2323 (2) may license, control, and otherwise regulate each
2424 private passenger vehicle, regardless of how it is propelled, that
2525 provides passenger limousine transportation services for
2626 compensation and is designed for carrying no more than 15
2727 passengers.
2828 (a-1) Subsection (a) applies to a passenger transportation
2929 [taxicab or limousine] service that provides passenger
3030 transportation services for compensation to passengers [is
3131 operated]:
3232 (1) within the jurisdiction of the municipality;
3333 (2) on property owned by the municipality, singly or
3434 jointly with one or more other municipalities or public agencies;
3535 (3) on property in which the municipality possesses an
3636 ownership interest; or
3737 (4) by transporting from the municipality, municipal
3838 property, or property in which the municipality has an interest and
3939 returning to it.
4040 (b) The ordinance may include:
4141 (1) regulation of the entry into the business of
4242 providing passenger [taxicab or limousine] transportation services
4343 for compensation[, including controls, limits, or other
4444 restrictions on the total number of persons providing the
4545 services];
4646 (2) regulation of the rates charged for the provision
4747 of the services;
4848 (3) establishment of safety and insurance
4949 requirements; and
5050 (4) any other requirement adopted to ensure safe and
5151 reliable passenger transportation service.
5252 (c) In regulating passenger [taxicab or limousine]
5353 transportation services for compensation under this section, a
5454 municipality is performing a governmental function. A municipality
5555 may carry out the provisions of this section to the extent the
5656 governing body of the municipality considers it necessary or
5757 appropriate.
5858 SECTION 3. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2015.
