55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment and administration of a program by
88 the Texas Department of Housing and Community Affairs for the
99 demolition and replacement of unsafe housing.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter K, Chapter 2306, Government Code, is
1212 amended by adding Section 2306.2595 to read as follows:
1313 Sec. 2306.2595. TEXAS SAFE HOME PROGRAM. (a) The
1414 department shall establish and administer a program to provide
1515 financial assistance for the demolition and replacement of
1616 owner-occupied single-family homes that are in a condition that
1717 poses a risk to the health and safety of the occupants.
1818 (b) The board shall adopt rules to implement the program
1919 described by this section. Rules adopted under this section must
2020 establish:
2121 (1) procedures and forms for nominating a household
2222 for participation in the program;
2323 (2) eligibility criteria for participation in the
2424 program, including criteria based on:
2525 (A) the financial need of the household;
2626 (B) the physical condition of the home; and
2727 (C) other criteria the board considers
2828 necessary;
2929 (3) procedures for evaluating a household's
3030 eligibility for participation in the program;
3131 (4) a system that:
3232 (A) prioritizes and maximizes the allocation of
3333 available funds; and
3434 (B) includes the assignment of eligible
3535 households to specific funding priority levels that are designed to
3636 ensure the most effective use of funds for the most exigent
3737 circumstances; and
3838 (5) the manner in which a nomination must be made and
3939 the manner in which households will be assigned to a specific
4040 funding priority level under the system described by Subdivision
4141 (4).
4242 (c) Funding priority levels described by Subsection
4343 (b)(4)(B) must give high priority to:
4444 (1) households with children, the elderly, or persons
4545 with disabilities;
4646 (2) households whose health and safety are at greatest
4747 risk due to the continued occupancy of a home described by
4848 Subsection (a); and
4949 (3) households that:
5050 (A) are eligible for and will receive third-party
5151 contributions, including volunteer labor or additional loans,
5252 grants, or other financial assistance; or
5353 (B) will contribute labor in the demolition or
5454 construction of the home.
5555 (d) A household may be nominated for participation in the
5656 program by a mayor, fire chief, fire marshal, volunteer fire chief,
5757 county commissioner, or county judge filing a nomination with the
5858 department.
5959 (e) On receipt of a nomination regarding a household, the
6060 department shall determine whether the household is eligible to
6161 participate in the program. If the household is eligible, the
6262 department shall establish a funding priority level for the
6363 household.
6464 (f) A household may not be required to participate in the
6565 program.
6666 (g) In determining whether a nominated household is
6767 eligible for participation in the program and for the purpose of
6868 establishing a funding priority level for the household, a
6969 representative or designee of the manufactured housing division of
7070 the department shall inspect the home with the homeowner and with
7171 the person who nominated the household or that person's designee.
7272 (h) Financial assistance administered under this section
7373 may be provided in the form of a grant, partial grant, loan, or
7474 forgivable loan.
7575 (i) The department shall establish in the housing trust fund
7676 a subaccount that may be used only for providing financial
7777 assistance through the program established under this section. The
7878 subaccount consists of:
7979 (1) money deposited to the subaccount under Section
8080 158.056, Tax Code;
8181 (2) appropriations or transfers made to the
8282 subaccount;
8383 (3) unencumbered balances of the subaccount;
8484 (4) public or private gifts, grants, or donations;
8585 (5) investment income, including all interest,
8686 dividends, capital gains, or other income from the investment of
8787 any portion of the subaccount;
8888 (6) repayments received on any loans made from the
8989 subaccount; and
9090 (7) funds from any other source.
9191 (j) The department shall attempt to secure an agreement
9292 with:
9393 (1) private lending institutions for below market rate
9494 loans for use in the program; and
9595 (2) manufacturers of manufactured housing for the
9696 provision of HUD-code manufactured homes at a discounted price.
9797 (k) An entity that enters into an agreement with the
9898 department under Subsection (j) may:
9999 (1) be designated as an "Official Partner of the State
100100 of Texas for Safe and Affordable Homes"; and
101101 (2) use the designation described by Subdivision (1)
102102 in advertising and promotion.
103103 (l) The department may enter into a contract for the
104104 administration of the program.
105105 (m) Not later than September 1 of each year, the department
106106 shall submit to the governor, the lieutenant governor, the speaker
107107 of the house of representatives, and the state fire marshal a report
108108 that documents for the preceding state fiscal year the number of
109109 households that participated in the program, the nature of the
110110 financial assistance provided under the program, and the amounts of
111111 public and private financial assistance administered through the
112112 program.
113113 SECTION 2. Section 158.056, Tax Code, is amended by adding
114114 Subsection (c) to read as follows:
115115 (c) The comptroller shall deposit the tax imposed under this
116116 section to the credit of the housing trust fund subaccount
117117 established under Section 2306.2595, Government Code, for use only
118118 for the purposes authorized by that section.
119119 SECTION 3. This Act takes effect September 1, 2015.
