64 AN ACT
75 relating to the employment of persons under 18 years of age on the
86 premises of certain businesses selling or serving alcoholic
97 beverages; adding a provision that is subject to a criminal
108 penalty.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 106.09, Alcoholic Beverage Code, is
1311 amended by amending Subsection (a) and adding Subsection (f) to
1412 read as follows:
1513 (a) Except as provided by [in] Subsections (b), (c), [and]
1614 (e), and (f) [of this section], no person may employ a person under
1715 18 years of age to sell, prepare, serve, or otherwise handle liquor,
1816 or to assist in doing so.
1917 (f) The holder of a permit or license providing for the
2018 on-premises consumption of alcoholic beverages that derives less
2119 than 50 percent of its gross receipts for the premises from the sale
2220 or service of alcoholic beverages may employ a person under 18 years
2321 of age to work as a cashier for transactions involving the sale of
2422 alcoholic beverages if the alcoholic beverages are served by a
2523 person 18 years of age or older.
2624 SECTION 2. The change in law made by this Act to Section
2725 106.09, Alcoholic Beverage Code, applies only to an offense
2826 committed on or after the effective date of this Act. An offense
2927 committed before the effective date of this Act is covered by the
3028 law in effect when the offense was committed, and the former law is
3129 continued in effect for that purpose. For purposes of this section,
3230 an offense was committed before the effective date of this Act if
3331 any element of the offense occurred before that date.
3432 SECTION 3. This Act takes effect immediately if it receives
3533 a vote of two-thirds of all the members elected to each house, as
3634 provided by Section 39, Article III, Texas Constitution. If this
3735 Act does not receive the vote necessary for immediate effect, this
3836 Act takes effect September 1, 2015.
