16 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

17 | 10 | | SECTION 1. Section 19.01, Alcoholic Beverage Code, is |
---|
18 | 11 | | amended to read as follows: |
---|
19 | 12 | | Sec. 19.01. AUTHORIZED ACTIVITIES. The holder of a |
---|
20 | 13 | | wholesaler's permit may: |
---|
21 | 14 | | (1) purchase and import liquor from distillers, |
---|
22 | 15 | | brewers, wineries, wine bottlers, rectifiers, and manufacturers |
---|
23 | 16 | | who are holders of nonresident seller's permits or from their |
---|
24 | 17 | | agents who hold manufacturer's agents permits; |
---|
25 | 18 | | (2) purchase ale and malt liquor from holders of |
---|
26 | 19 | | brewpub licenses; |
---|
27 | 20 | | (3) purchase liquor from other wholesalers in the |
---|
28 | 21 | | state; |
---|
29 | 22 | | (4) [(3)] sell liquor in the original containers in |
---|
30 | 23 | | which it is received to retailers and wholesalers in this state |
---|
31 | 24 | | authorized to sell the liquor; |
---|
32 | 25 | | (5) [(4)] sell liquor to qualified persons outside the |
---|
33 | 26 | | state; and |
---|
34 | 27 | | (6) [(5)] sell ale and malt liquor to a holder of a |
---|
35 | 28 | | private club registration permit. |
---|
36 | 29 | | SECTION 2. Section 21.01, Alcoholic Beverage Code, is |
---|
37 | 30 | | amended to read as follows: |
---|
38 | 31 | | Sec. 21.01. AUTHORIZED ACTIVITIES. The holder of a local |
---|
39 | 32 | | class B wholesaler's permit may: |
---|
40 | 33 | | (1) purchase and import malt and vinous liquors from |
---|
41 | 34 | | brewers, wineries, rectifiers, and wine manufacturers and bottlers |
---|
42 | 35 | | who are holders of nonresident seller's permits and from their |
---|
43 | 36 | | agents who are holders of manufacturer's agent permits; |
---|
44 | 37 | | (2) purchase malt and vinous liquors from holders of |
---|
45 | 38 | | brewer's permits, holders of brewpub licenses, and [from] other |
---|
46 | 39 | | wholesalers in the state; |
---|
47 | 40 | | (3) sell the malt and vinous liquors, in the original |
---|
48 | 41 | | containers in which the permit holder [he] receives them, to |
---|
49 | 42 | | general and local class B wholesaler's permittees and, in the |
---|
50 | 43 | | permit holder's [his] county of residence, to local distributor's |
---|
51 | 44 | | permittees and retailers, including mixed beverage permittees and |
---|
52 | 45 | | daily temporary mixed beverage permittees; and |
---|
53 | 46 | | (4) sell ale and malt liquor to a holder of a private |
---|
54 | 47 | | club registration permit. |
---|
55 | 48 | | SECTION 3. Section 65.01(a), Alcoholic Beverage Code, is |
---|
56 | 49 | | amended to read as follows: |
---|
57 | 50 | | (a) The holder of a local distributor's license may: |
---|
58 | 51 | | (1) receive beer in unbroken original packages from |
---|
59 | 52 | | manufacturers and brewpubs and from general, branch, or local |
---|
60 | 53 | | distributors; |
---|
61 | 54 | | (2) sell and distribute beer in the unbroken original |
---|
62 | 55 | | packages in which it is received: |
---|
63 | 56 | | (A) to the following, if located in the county of |
---|
64 | 57 | | the licensee's residence: local distributor permittees, |
---|
65 | 58 | | permittees or licensees authorized to sell to ultimate consumers, |
---|
66 | 59 | | private club registration permittees, authorized outlets located |
---|
67 | 60 | | on any installation of the national military establishment, or |
---|
68 | 61 | | qualified persons for shipment and consumption outside the state; |
---|
69 | 62 | | or |
---|
70 | 63 | | (B) to other licensed distributors in the state; |
---|
71 | 64 | | and |
---|
72 | 65 | | (3) serve free beer for consumption on the licensed |
---|
73 | 66 | | premises. |
---|
74 | 67 | | SECTION 4. Section 74.09(a), Alcoholic Beverage Code, is |
---|
75 | 68 | | amended to read as follows: |
---|
76 | 69 | | (a) In addition to the activities authorized by Section |
---|
77 | 70 | | 74.01, the holder of a brewpub license may sell beer produced under |
---|
78 | 71 | | the license to the holder of a general, local, or branch |
---|
79 | 72 | | distributor's license or to qualified distributors outside the |
---|
80 | 73 | | state. |
---|
81 | 74 | | SECTION 5. Section 74.10(a), Alcoholic Beverage Code, is |
---|
82 | 75 | | amended to read as follows: |
---|
83 | 76 | | (a) In addition to the activities authorized by Section |
---|
84 | 77 | | 74.01, the holder of a brewpub license may sell ale and malt liquor |
---|
85 | 78 | | to the holder of a wholesaler's permit, a general class B |
---|
86 | 79 | | wholesaler's permit, or a local class B wholesaler's permit or to |
---|
87 | 80 | | qualified wholesalers outside the state. |
---|
88 | 81 | | SECTION 6. This Act takes effect immediately if it receives |
---|
89 | 82 | | a vote of two-thirds of all the members elected to each house, as |
---|
90 | 83 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
91 | 84 | | Act does not receive the vote necessary for immediate effect, this |
---|
92 | 85 | | Act takes effect September 1, 2015. |
