114 A BILL TO BE ENTITLED
125 AN ACT
136 relating to allowing the holder of a brewpub license to sell beer,
147 ale, and malt liquor to certain wholesalers, distributors, and
158 qualified persons outside the state.
169 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1710 SECTION 1. Section 19.01, Alcoholic Beverage Code, is
1811 amended to read as follows:
1912 Sec. 19.01. AUTHORIZED ACTIVITIES. The holder of a
2013 wholesaler's permit may:
2114 (1) purchase and import liquor from distillers,
2215 brewers, wineries, wine bottlers, rectifiers, and manufacturers
2316 who are holders of nonresident seller's permits or from their
2417 agents who hold manufacturer's agents permits;
2518 (2) purchase ale and malt liquor from holders of
2619 brewpub licenses;
2720 (3) purchase liquor from other wholesalers in the
2821 state;
2922 (4) [(3)] sell liquor in the original containers in
3023 which it is received to retailers and wholesalers in this state
3124 authorized to sell the liquor;
3225 (5) [(4)] sell liquor to qualified persons outside the
3326 state; and
3427 (6) [(5)] sell ale and malt liquor to a holder of a
3528 private club registration permit.
3629 SECTION 2. Section 21.01, Alcoholic Beverage Code, is
3730 amended to read as follows:
3831 Sec. 21.01. AUTHORIZED ACTIVITIES. The holder of a local
3932 class B wholesaler's permit may:
4033 (1) purchase and import malt and vinous liquors from
4134 brewers, wineries, rectifiers, and wine manufacturers and bottlers
4235 who are holders of nonresident seller's permits and from their
4336 agents who are holders of manufacturer's agent permits;
4437 (2) purchase malt and vinous liquors from holders of
4538 brewer's permits, holders of brewpub licenses, and [from] other
4639 wholesalers in the state;
4740 (3) sell the malt and vinous liquors, in the original
4841 containers in which the permit holder [he] receives them, to
4942 general and local class B wholesaler's permittees and, in the
5043 permit holder's [his] county of residence, to local distributor's
5144 permittees and retailers, including mixed beverage permittees and
5245 daily temporary mixed beverage permittees; and
5346 (4) sell ale and malt liquor to a holder of a private
5447 club registration permit.
5548 SECTION 3. Section 65.01(a), Alcoholic Beverage Code, is
5649 amended to read as follows:
5750 (a) The holder of a local distributor's license may:
5851 (1) receive beer in unbroken original packages from
5952 manufacturers and brewpubs and from general, branch, or local
6053 distributors;
6154 (2) sell and distribute beer in the unbroken original
6255 packages in which it is received:
6356 (A) to the following, if located in the county of
6457 the licensee's residence: local distributor permittees,
6558 permittees or licensees authorized to sell to ultimate consumers,
6659 private club registration permittees, authorized outlets located
6760 on any installation of the national military establishment, or
6861 qualified persons for shipment and consumption outside the state;
6962 or
7063 (B) to other licensed distributors in the state;
7164 and
7265 (3) serve free beer for consumption on the licensed
7366 premises.
7467 SECTION 4. Section 74.09(a), Alcoholic Beverage Code, is
7568 amended to read as follows:
7669 (a) In addition to the activities authorized by Section
7770 74.01, the holder of a brewpub license may sell beer produced under
7871 the license to the holder of a general, local, or branch
7972 distributor's license or to qualified distributors outside the
8073 state.
8174 SECTION 5. Section 74.10(a), Alcoholic Beverage Code, is
8275 amended to read as follows:
8376 (a) In addition to the activities authorized by Section
8477 74.01, the holder of a brewpub license may sell ale and malt liquor
8578 to the holder of a wholesaler's permit, a general class B
8679 wholesaler's permit, or a local class B wholesaler's permit or to
8780 qualified wholesalers outside the state.
8881 SECTION 6. This Act takes effect immediately if it receives
8982 a vote of two-thirds of all the members elected to each house, as
9083 provided by Section 39, Article III, Texas Constitution. If this
9184 Act does not receive the vote necessary for immediate effect, this
9285 Act takes effect September 1, 2015.
