75 relating to Texas Higher Education Coordinating Board fees for the
86 administration of certificates of authorization and certificates
97 of authority issued to certain postsecondary educational
108 institutions; authorizing fees.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 61.303, Education Code, is amended by
1311 adding Subsections (g) and (h) to read as follows:
1412 (g) The board by rule may establish a fee to be charged by
1513 the board to cover all or a portion of the board's costs associated
1614 with:
1715 (1) issuing, maintaining, or revising a certificate of
1816 authorization or certificate of authority; and
1917 (2) maintaining a repository for student transcripts
2018 from closed institutions that were authorized to operate under a
2119 certificate of authorization or certificate of authority.
2220 (h) The amount of a fee established under Subsection (g) may
2321 not exceed the following:
2422 (1) $1,500 for an initial approval;
2523 (2) $750 for an annual review;
2624 (3) $250 for an institution name change;
2725 (4) $250 for a degree, program, or credential-level
2826 change;
2927 (5) $250 for a new degree, program, or credential
3028 level;
3129 (6) $500 for an accrediting agency change; or
3230 (7) $500 for an ownership or governance change.
3331 SECTION 2. Section 61.315, Education Code, is amended to
3432 read as follows:
3533 Sec. 61.315. AGENTS AND RECORDS; TRANSCRIPT REPOSITORY AND
3634 RELATED FEES. (a) The authorized or certified institutions may be
3735 required to furnish a list of their agents to the board, and to
3836 maintain records of students enrolled, credits awarded, and degrees
3937 awarded in a manner specified by the board.
4038 (b) The board shall maintain a repository for student
4139 transcripts from closed institutions that were authorized to
4240 operate under a certificate of authorization or certificate of
4341 authority using fees received by the board from institutions
4442 operating under those certificates as part of the institutions'
4543 initial and ongoing authorization to operate. If those fees are not
4644 sufficient to cover the cost of maintaining the repository, the
4745 board may discontinue its maintenance of the repository, unless
4846 adequate state funding is provided for that maintenance. The board
4947 may charge a fee to students requesting transcript copies
5048 maintained in the repository, not to exceed the cost of retrieving,
5149 reproducing, and sending the transcript copies. A closed or
5250 closing institution shall provide its student transcript records to
5351 the board in the format specified by the board for inclusion in the
5452 repository.
5553 SECTION 3. Subchapter H, Chapter 61, Education Code, is
5654 amended by adding Section 61.4031 to read as follows:
5755 Sec. 61.4031. CERTIFICATE OF AUTHORIZATION OR AUTHORITY
5856 FEE. (a) The board by rule may establish a fee to be charged by the
5957 board to cover all or a portion of the board's costs associated
6058 with:
6159 (1) issuing, maintaining, or revising a certificate of
6260 authorization or certificate of authority issued under a rule
6361 adopted under this subchapter; and
6462 (2) maintaining a repository for student transcripts
6563 from closed institutions that were authorized to operate under a
6664 certificate of authorization or certificate of authority issued
6765 under a rule adopted under this subchapter.
6866 (b) The amount of a fee established under this section may
6967 not exceed the following:
7068 (1) $1,500 for an initial approval;
7169 (2) $750 for an annual review;
7270 (3) $250 for an institution name change;
7371 (4) $250 for a degree, program, or credential-level
7472 change;
7573 (5) $250 for a new degree, program, or credential
7674 level;
7775 (6) $500 for an accrediting agency change; or
7876 (7) $500 for an ownership or governance change.
7977 SECTION 4. This Act takes effect immediately if it receives
8078 a vote of two-thirds of all the members elected to each house, as
8179 provided by Section 39, Article III, Texas Constitution. If this
8280 Act does not receive the vote necessary for immediate effect, this
8381 Act takes effect September 1, 2015.
