64 AN ACT
75 relating to excepting manufacturers engaged in certain commercial
86 research and development from certain provisions of the Texas
97 Controlled Substances Act.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Section 481.080, Health and Safety Code, is
1210 amended by adding Subsection (d-1) to read as follows:
1311 (d-1) This section does not apply to a chemical manufacturer
1412 engaged in commercial research and development:
1513 (1) whose primary business is the manufacture, use,
1614 storage, or transportation of hazardous, combustible, or explosive
1715 materials;
1816 (2) that operates a secure, restricted location that
1917 contains a physical plant not open to the public, the ingress into
2018 which is constantly monitored by security personnel; and
2119 (3) that holds:
2220 (A) a Voluntary Protection Program Certification
2321 under Section (2)(b)(1), Occupational Safety and Health Act of 1970
2422 (29 U.S.C. Section 651 et seq.); or
2523 (B) a Facility Operations Area authorization
2624 under the Texas Risk Reduction Program (30 T.A.C. Chapter 350).
2725 SECTION 2. This Act takes effect immediately if it receives
2826 a vote of two-thirds of all the members elected to each house, as
2927 provided by Section 39, Article III, Texas Constitution. If this
3028 Act does not receive the vote necessary for immediate effect, this
3129 Act takes effect September 1, 2015.
