11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter B, Chapter 45, Government Code, is |
---|
13 | 13 | | amended by adding Section 45.194 to read as follows: |
---|
14 | 14 | | Sec. 45.194. GUADALUPE COUNTY. (a) In Guadalupe County the |
---|
15 | 15 | | county attorney of Guadalupe County shall perform the duties |
---|
16 | 16 | | imposed on and have the powers conferred on district attorneys by |
---|
17 | 17 | | general law and is entitled to be compensated by the state in the |
---|
18 | 18 | | manner and amount set by general law relating to the salary paid to |
---|
19 | 19 | | district attorneys by the state. |
---|
20 | 20 | | (b) The county attorney of Guadalupe County or the |
---|
21 | 21 | | Commissioners Court of Guadalupe County may accept gifts or grants |
---|
22 | 22 | | from any individual, partnership, corporation, trust, foundation, |
---|
23 | 23 | | association, or governmental entity for the purpose of financing or |
---|
24 | 24 | | assisting the operation of the office of county attorney in |
---|
25 | 25 | | Guadalupe County. The county attorney shall account for and report |
---|
26 | 26 | | to the commissioners court all gifts or grants accepted under this |
---|
27 | 27 | | subsection. |
---|
28 | 28 | | SECTION 2. Section 46.002, Government Code, is amended to |
---|
29 | 29 | | read as follows: |
---|
30 | 30 | | Sec. 46.002. PROSECUTORS SUBJECT TO CHAPTER. This chapter |
---|
31 | 31 | | applies to the state prosecuting attorney, all county prosecutors, |
---|
32 | 32 | | and the following state prosecutors: |

33 | 33 | | (1) the district attorneys for Kenedy and Kleberg |
---|
34 | 34 | | Counties and for the 1st, 2nd, 8th, 9th, 18th, 21st, 23rd, [25th,] |

57 | 57 | | SECTION 3. Section 43.112, Government Code, as amended by |

59 | 59 | | Legislature, Regular Session, 2013, is repealed. |

60 | 60 | | SECTION 4. On January 1, 2017, the office of district |

61 | 61 | | attorney for the 25th Judicial District is abolished. |

62 | 62 | | SECTION 5. This Act takes effect January 1, 2017. |
