66 AN ACT
77 relating to the membership of school district and open-enrollment
88 charter school concussion oversight teams.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 38.151, Education Code, is amended by
1111 adding Subdivision (2-a) and amending Subdivision (5) to read as
1212 follows:
1313 (2-a) "Chiropractor" has the meaning assigned by
1414 Section 201.001, Occupations Code.
1515 (5) "Licensed health care professional" means an
1616 advanced practice nurse, athletic trainer, chiropractor,
1717 neuropsychologist, or physician assistant, as those terms are
1818 defined by this section.
1919 SECTION 2. Section 38.154(a), Education Code, is amended to
2020 read as follows:
2121 (a) Each concussion oversight team must include at least one
2222 physician and, to the greatest extent practicable, considering
2323 factors including the population of the metropolitan statistical
2424 area in which the school district or open-enrollment charter school
2525 is located, district or charter school student enrollment, and the
2626 availability of and access to licensed health care professionals in
2727 the district or charter school area, must also include one or more
2828 of the following:
2929 (1) an athletic trainer;
3030 (2) an advanced practice nurse;
3131 (3) a neuropsychologist; [or]
3232 (4) a physician assistant; or
3333 (5) a chiropractor.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2015.
