| 8 | 8 | | charter school concussion oversight teams. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 38.151, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subdivision (2-a) and amending Subdivision (5) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (2-a) "Chiropractor" has the meaning assigned by |
|---|
| 14 | 14 | | Section 201.001, Occupations Code. |
|---|
| 15 | 15 | | (5) "Licensed health care professional" means an |
|---|
| 16 | 16 | | advanced practice nurse, athletic trainer, chiropractor, |
|---|
| 17 | 17 | | neuropsychologist, or physician assistant, as those terms are |
|---|
| 18 | 18 | | defined by this section. |
|---|
| 19 | 19 | | SECTION 2. Section 38.154(a), Education Code, is amended to |
|---|
| 20 | 20 | | read as follows: |
|---|
| 21 | 21 | | (a) Each concussion oversight team must include at least one |
|---|
| 22 | 22 | | physician and, to the greatest extent practicable, considering |
|---|
| 23 | 23 | | factors including the population of the metropolitan statistical |
|---|
| 24 | 24 | | area in which the school district or open-enrollment charter school |
|---|
| 25 | 25 | | is located, district or charter school student enrollment, and the |
|---|
| 26 | 26 | | availability of and access to licensed health care professionals in |
|---|
| 27 | 27 | | the district or charter school area, must also include one or more |
|---|
| 28 | 28 | | of the following: |
|---|
| 29 | 29 | | (1) an athletic trainer; |
|---|
| 30 | 30 | | (2) an advanced practice nurse; |
|---|
| 31 | 31 | | (3) a neuropsychologist; [or] |
|---|
| 32 | 32 | | (4) a physician assistant; or |
|---|
| 33 | 33 | | (5) a chiropractor. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2015. |
