7 | 7 | | relating to the reimbursement of providers under the Medicaid |
---|
8 | 8 | | program for the provision of telemedicine medical services in a |
---|
9 | 9 | | school-based setting. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 531.0217, Government Code, is amended by |
---|
12 | 12 | | adding Subsection (c-4) and amending Subsection (g) to read as |
---|
13 | 13 | | follows: |
---|
14 | 14 | | (c-4) The commission shall ensure that Medicaid |
---|
15 | 15 | | reimbursement is provided to a physician for a telemedicine medical |
---|
16 | 16 | | service provided by the physician, even if the physician is not the |
---|
17 | 17 | | patient's primary care physician or provider, if: |
---|
18 | 18 | | (1) the physician is an authorized health care |
---|
19 | 19 | | provider under the Medicaid program; |
---|
20 | 20 | | (2) the patient is a child who receives the service in |
---|
21 | 21 | | a primary or secondary school-based setting; and |
---|
22 | 22 | | (3) a health professional is present with the patient |
---|
23 | 23 | | during the treatment. |
---|
24 | 24 | | (g) If a patient receiving a telemedicine medical service |
---|
25 | 25 | | has a primary care physician or provider and consents or, if |
---|
26 | 26 | | appropriate, the patient's parent or legal guardian consents to the |
---|
27 | 27 | | notification, the commission may [shall] require that the primary |
---|
28 | 28 | | care physician or provider be notified of the telemedicine medical |
---|
29 | 29 | | service for the purpose of sharing medical information. In the case |
---|
30 | 30 | | of a service provided to a child in a school-based setting as |
---|
31 | 31 | | described by Subsection (c-4), the notification, if any, must |
---|
32 | 32 | | include a summary of the service, including exam findings, |
---|
33 | 33 | | prescribed or administered medications, and patient instructions. |
---|
34 | 34 | | SECTION 2. If before implementing any provision of this Act |
---|
35 | 35 | | a state agency determines that a waiver or authorization from a |
---|
36 | 36 | | federal agency is necessary for implementation of that provision, |
---|
37 | 37 | | the agency affected by the provision shall request the waiver or |
---|
38 | 38 | | authorization and may delay implementing that provision until the |
---|
39 | 39 | | waiver or authorization is granted. |
---|
40 | 40 | | SECTION 3. This Act takes effect September 1, 2015. |
