55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the reimbursement of providers under the Medicaid
88 program for the provision of telemedicine medical services in a
99 school-based setting.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 531.0217, Government Code, is amended by
1212 adding Subsection (c-4) and amending Subsection (g) to read as
1313 follows:
1414 (c-4) The commission shall ensure that Medicaid
1515 reimbursement is provided to a physician for a telemedicine medical
1616 service provided by the physician, even if the physician is not the
1717 patient's primary care physician or provider, if:
1818 (1) the physician is an authorized health care
1919 provider under the Medicaid program;
2020 (2) the patient is a child who receives the service in
2121 a primary or secondary school-based setting; and
2222 (3) a health professional is present with the patient
2323 during the treatment.
2424 (g) If a patient receiving a telemedicine medical service
2525 has a primary care physician or provider and consents or, if
2626 appropriate, the patient's parent or legal guardian consents to the
2727 notification, the commission may [shall] require that the primary
2828 care physician or provider be notified of the telemedicine medical
2929 service for the purpose of sharing medical information. In the case
3030 of a service provided to a child in a school-based setting as
3131 described by Subsection (c-4), the notification, if any, must
3232 include a summary of the service, including exam findings,
3333 prescribed or administered medications, and patient instructions.
3434 SECTION 2. If before implementing any provision of this Act
3535 a state agency determines that a waiver or authorization from a
3636 federal agency is necessary for implementation of that provision,
3737 the agency affected by the provision shall request the waiver or
3838 authorization and may delay implementing that provision until the
3939 waiver or authorization is granted.
4040 SECTION 3. This Act takes effect September 1, 2015.
