1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to the territory included in, the composition of the board
1414 of directors of, and the method of assessment of the Harris County
1515 Improvement District No. 10 and to clarifying the law to reflect
1616 the prior division of the district.
1717 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1818 SECTION 1. The heading to Chapter 3860, Special District
1919 Local Laws Code, is amended to read as follows:
2020 CHAPTER 3860. HARRIS COUNTY IMPROVEMENT DISTRICT NO. 10 AND FIVE
2121 CORNERS IMPROVEMENT DISTRICT
2222 SECTION 2. Section 3860.001(2), Special District Local Laws
2323 Code, is amended to read as follows:
2424 (2) "District" means the Harris County Improvement
2525 District No. 10 or the Five Corners Improvement District, as
2626 appropriate.
2727 SECTION 3. Section 3860.111, Special District Local Laws
2828 Code, is amended to read as follows:
2929 Sec. 3860.111. DIVISION OF DISTRICT. (a) As provided by
3030 Chapter 968, Acts of the 80th Legislature, Regular Session, 2007,
3131 and Chapter 1091, Acts of the 81st Legislature, Regular Session,
3232 2009, the district was divided into the Harris County Improvement
3333 District No. 10 and the Five Corners Improvement District [The
3434 district shall be divided into two districts only if the district is
3535 not imposing ad valorem taxes].
3636 (b) The Harris County Improvement District No. 10 [Not
3737 later than the 60th day after the effective date of the Act creating
3838 this chapter, the board shall adopt an order dividing the district
3939 into two districts. The original district] includes all district
4040 territory not included in the Five Corners Improvement District
4141 [new district].
4242 (c) The Five Corners Improvement District [new district]
4343 includes:
4444 (1) all the territory included in state representative
4545 district 131 on the date the order of division was [is] effective;
4646 (2) territory added to the district by Chapter 1091,
4747 Acts of the 81st Legislature, Regular Session, 2009; and
4848 (3) any territory added by other law.
4949 (d) Notwithstanding Section 3860.051(a), [Neither district
5050 may request consent to its creation from the City of Houston until
5151 the order dividing the district is adopted.
5252 [(c) After the division of the district:
5353 [(1)] the Harris County Improvement District No. 10
5454 [original district] is governed by a board of nine [seven] voting
5555 directors [consisting of the directors appointed to positions 8
5656 through 14;] and
5757 [(2)] the Five Corners Improvement District [new
5858 district] is governed by a board of nine [seven] voting directors
5959 [consisting of the directors appointed to positions one through
6060 seven of the original district].
6161 [(d) An order dividing the district must:
6262 [(1) name the new district;
6363 [(2) describe the boundaries of the new district;
6464 [(3) name the initial directors of the new district;
6565 and
6666 [(4) divide the assets and liabilities in any manner
6767 between the new district and the original district.]
6868 (e) [Not later than the 10th day after the date the board
6969 adopts the order, the district shall file the order with the Texas
7070 Commission on Environmental Quality and record the order in the
7171 real property records of Harris County.
7272 [(f)] The Harris County Improvement District No. 10 and the
7373 Five Corners Improvement District have [new district has] all the
7474 powers and duties of the district created by Chapter 968, Acts of
7575 the 80th Legislature, Regular Session, 2007, and any applicable
7676 subsequently enacted law.
7777 SECTION 4. Chapter 3860, Special District Local Laws Code,
7878 is amended by adding Subchapter E-1 to read as follows:
7979 SUBCHAPTER E-1. FINANCIAL PROVISIONS FOR HARRIS COUNTY
8080 IMPROVEMENT DISTRICT NO. 10
8181 Sec. 3860.221. APPLICABILITY. This subchapter applies to
8282 the Harris County Improvement District No. 10. This subchapter
8383 does not apply to the Five Corners Improvement District.
8484 Sec. 3860.222. 10-YEAR PLAN. (a) If the board adopts an
8585 order under Section 375.116, Local Government Code, before January
8686 1, 2017, that grants a petition for improvement projects or
8787 services financed through a 10-year assessment period, the board
8888 shall create a 10-year plan for the management of the project or
8989 service and assessments.
9090 (b) The board shall include in an order that levies
9191 assessments described by Subsection (a):
9292 (1) the amount of annual installments during the
9393 10-year assessment period; and
9494 (2) penalties and interest the district may collect on
9595 delinquent assessments.
9696 Sec. 3860.223. ASSESSMENT DISTRIBUTION. To provide
9797 sufficient funds for projects and programs dedicated to public
9898 improvements in preparation for the 2017 Super Bowl, a 10-year plan
9999 adopted under Section 3860.222 must provide that:
100100 (1) of the levy from the first 5 years of the 10-year
101101 assessment period:
102102 (A) 60 percent shall be apportioned to fund
103103 services and improvements in the territory added to the Harris
104104 County Improvement District No. 10 after March 1, 2015; and
105105 (B) 40 percent shall be apportioned to fund
106106 services and improvements in the territory of the Harris County
107107 Improvement District No. 10 that existed on March 1, 2015; and
108108 (2) of the levy from the last 5 years of the 10-year
109109 assessment period:
110110 (A) 60 percent shall be apportioned to fund
111111 services and improvements in the territory of the Harris County
112112 Improvement District No. 10 that existed on March 1, 2015; and
113113 (B) 40 percent shall be apportioned to fund
114114 services and improvements in the territory added to the Harris
115115 County Improvement District No. 10 after March 1, 2015.
116116 SECTION 5. (a) The change in law made to Section
117117 3860.111(c)(2), Special District Local Laws Code, by this Act
118118 conforms the law relating to the number of directors serving on the
119119 board of the Five Corners Improvement District to reflect the
120120 number of directors serving on the effective date of this Act. This
121121 Act does not otherwise affect that board.
122122 (b) The terms of the members of the board of the Harris
123123 County Improvement District No. 10 serving on the effective date of
124124 this Act who were appointed under Chapter 3860, Special District
125125 Local Laws Code, before the effective date of this Act expire on the
126126 effective date of this Act. On the effective date of this Act, the
127127 board of directors of the Harris County Improvement District No. 10
128128 is composed of the following directors:
129129 (1) E. D. Wulfe
130130 (2) Leroy Shafer
131131 (3) Camille Foster
132132 (4) Rodney Jones
133133 (5) Brandon Dudley
134134 (6) J. Kent Friedman
135135 (7) Willie Belle Boone

138138 (c) The terms of the directors in positions (b)(2), (4),
139139 (6), and (8) of this section expire June 1, 2017.
140140 (d) The terms of the directors in positions (b)(1), (3),
141141 (5), (7), and (9) of this section expire June 1, 2019.
142142 (e) The mayor and members of the governing body of the City
143143 of Houston shall appoint successor directors as provided by Section
144144 375.064, Local Government Code, and Section 3860.052, Special
145145 District Local Laws Code.
146146 SECTION 6. The following territory in Harris County is
147147 added to the territory of the Harris County Improvement District
148148 No. 10:
149149 Tract is +/- 2,058 acres (3.21 sq. miles) and beginning at a
150150 point where the south right-of-way (ROW) of El Paseo St. and east
151151 ROW of Cambridge St. intersect then south southwest along the east
152152 ROW of Cambridge St. to north ROW of Holly Hall St.;
153153 Then east along north ROW of Holly Hall St. to the ROW
154154 centerline of FM 521/Almeda Rd.;
155155 Then south southwest along the ROW centerline of FM
156156 521/Almeda Rd. to northwest corner of Harris County Improvement
157157 District (HCID) 10 A;
158158 Then south southwest along the west boundary of HCID No. 10 A

343343 SECTION 7. This Act takes effect immediately if it receives
344344 a vote of two-thirds of all the members elected to each house, as
345345 provided by Section 39, Article III, Texas Constitution. If this
346346 Act does not receive the vote necessary for immediate effect, this
347347 Act takes effect September 1, 2015.
