55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the transportation allotments provided under the
88 Foundation School Program to school districts that permit students
99 to select a campus of attendance.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 42.155(b), Education Code, is amended by
1212 adding Subdivision (4) to read as follows:
1313 (4) "School choice eligible student" means a student
1414 who resides two or more miles from the student's campus of choice,
1515 measured along the shortest route that may be traveled on public
1616 roads, and who is not classified as a student eligible for special
1717 education services.
1818 SECTION 2. Section 42.155, Education Code, is amended by
1919 adding Subsection (c-1) to read as follows:
2020 (c-1) This subsection applies only to a district that offers
2121 students residing in the district a variety of choices in selecting
2222 a campus for attendance and provides transportation to the selected
2323 campus at no cost to the students. The choices of campus offered
2424 must represent multiple factors, such as the sex of students
2525 enrolled at the campus, the subject matter or learning methods
2626 emphasized at the campus, and the degree to which athletic and other
2727 extracurricular activities are available at the campus. In
2828 addition to the regular transportation allotment under Subsection
2929 (c), a district is entitled to reimbursement for the costs of
3030 transportation provided to school choice eligible students.
3131 Reimbursement shall be provided in the same manner that
3232 reimbursement is provided for the costs of transporting career and
3333 technology education students under Subsection (f).
3434 SECTION 3. This Act takes effect September 1, 2015.
