55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the offense of passing certain vehicles on a highway.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 545.157(a), Transportation Code, is
1010 amended to read as follows:
1111 (a) This section applies only to the following vehicles:
1212 (1) a stationary authorized emergency vehicle using
1313 visual signals that meet the requirements of Sections 547.305 and
1414 547.702;
1515 (2) a stationary tow truck using equipment authorized
1616 by Section 547.305(d); [and]
1717 (3) a vehicle operated by or for the Texas Department
1818 of Transportation, a county, a municipality, or a toll project
1919 entity, as defined by Section 372.001, [vehicle] not separated from
2020 the roadway by a traffic control channelizing device and using
2121 visual signals that comply with the standards and specifications
2222 adopted under Section 547.105; and
2323 (4) a stationary vehicle operated by or for the Texas
2424 Department of Transportation, a county, a municipality, or a toll
2525 project entity, as defined by Section 372.001, assisting a stranded
2626 driver or a disabled vehicle and using visual signals that comply
2727 with the standards and specifications adopted under Section
2828 547.105.
2929 SECTION 2. This Act takes effect September 1, 2015.
