64 AN ACT
75 relating to the governance of certain housing authorities.
86 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
97 SECTION 1. Section 392.031(b), Local Government Code, is
108 amended to read as follows:
119 (b) A commissioner may not be an officer or employee of the
1210 municipality. A commissioner may be:
1311 (1) a tenant of a public project over which the housing
1412 authority has jurisdiction; or
1513 (2) a person who is a recipient of housing assistance
1614 administered through the authority's housing choice voucher
1715 program.
1816 SECTION 2. Section 392.0331, Local Government Code, is
1917 amended by amending Subsections (b), (g), and (h) and adding
2018 Subsections (b-2) and (h-1) to read as follows:
2119 (b) Except as provided by Subsection (b-1), in appointing
2220 commissioners under Section 392.031, a municipality with a
2321 municipal housing authority composed of five commissioners shall
2422 appoint at least one commissioner to the authority who is a tenant
2523 of a public housing project over which the authority has
2624 jurisdiction. Except as provided by Subsection (b-2), in [In]
2725 appointing commissioners under Section 392.031, a municipality
2826 with a municipal housing authority composed of seven or more
2927 commissioners shall appoint at least two commissioners to the
3028 authority who are tenants of a public housing project over which the
3129 authority has jurisdiction.
3230 (b-2) In appointing commissioners under Section 392.031, a
3331 municipality that has a population over two million and a municipal
3432 housing authority composed of seven or more commissioners shall
3533 appoint at least two commissioners to the authority who are:
3634 (1) tenants of a public housing project over which the
3735 authority has jurisdiction; or
3836 (2) recipients of housing assistance administered
3937 through the authority's housing choice voucher program.
4038 (g) A commissioner appointed under this section may not
4139 participate:
4240 (1) in any vote or discussion concerning the
4341 termination of:
4442 (A) the commissioner's occupancy rights in
4543 public housing;
4644 (B) the commissioner's rights to housing
4745 assistance administered through a housing choice voucher program;
4846 or
4947 (C) the rights of any person related in the first
5048 degree by consanguinity to the commissioner with respect to the
5149 person's occupancy rights in public housing or right to receive
5250 housing assistance administered through a housing choice voucher
5351 program; or
5452 (2) in a grievance or administrative hearing in which
5553 the commissioner or a person related in the first degree by
5654 consanguinity to the commissioner is a party.
5755 (h) If a commissioner appointed under this section as a
5856 tenant of a public housing project ceases to reside in a housing
5957 unit operated by the public housing authority during the
6058 commissioner's term, a majority of the other commissioners shall
6159 decide whether to request that a new commissioner be appointed. A
6260 majority of the commissioners may decide to allow the commissioner
6361 to serve the remaining portion of the commissioner's term.
6462 (h-1) If a commissioner appointed under this section as a
6563 recipient of housing assistance administered through the
6664 authority's housing choice voucher program ceases to receive that
6765 assistance, a majority of the other commissioners shall decide
6866 whether to request that a new commissioner be appointed. A majority
6967 of the commissioners may decide to allow the commissioner to serve
7068 the remaining portion of the commissioner's term.
7169 SECTION 3. This Act takes effect September 1, 2015.
