64 AN ACT
75 relating to the designation for criminal prosecution and other
86 purposes of certain chemicals commonly referred to as synthetic
97 cannabinoids as controlled substances and controlled substance
108 analogues under the Texas Controlled Substances Act.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Sections 481.002(5) and (6), Health and Safety
1311 Code, are amended to read as follows:
1412 (5) "Controlled substance" means a substance,
1513 including a drug, an adulterant, and a dilutant, listed in
1614 Schedules I through V or Penalty Group [Groups] 1, 1-A, [or] 2, 2-A,
1715 3, or [through] 4. The term includes the aggregate weight of any
1816 mixture, solution, or other substance containing a controlled
1917 substance.
2018 (6) "Controlled substance analogue" means:
2119 (A) a substance with a chemical structure
2220 substantially similar to the chemical structure of a controlled
2321 substance in Schedule I or II or Penalty Group 1, 1-A, [or] 2, or
2422 2-A; or
2523 (B) a substance specifically designed to produce
2624 an effect substantially similar to, or greater than, the effect of a
2725 controlled substance in Schedule I or II or Penalty Group 1, 1-A,
2826 [or] 2, or 2-A.
2927 SECTION 2. Section 481.1031, Health and Safety Code, is
3028 amended to read as follows:
3129 Sec. 481.1031. PENALTY GROUP 2-A. (a) In this section:
3230 (1) "Core component" is one of the following:
3331 azaindole, benzimidazole, benzothiazole, carbazole, imidazole,
3432 indane, indazole, indene, indole, pyrazole, pyrazolopyridine,
3533 pyridine, or pyrrole.
3634 (2) "Group A component" is one of the following:
3735 adamantane, benzene, cycloalkylmethyl, isoquinoline,
3836 methylpiperazine, naphthalene, phenyl, quinoline,
3937 tetrahydronaphthalene, tetramethylcyclopropane, amino oxobutane,
4038 amino dimethyl oxobutane, amino phenyl oxopropane, methyl methoxy
4139 oxobutane, methoxy dimethyl oxobutane, methoxy phenyl oxopropane,
4240 or an amino acid.
4341 (3) "Link component" is one of the following
4442 functional groups: carboxamide, carboxylate, hydrazide, methanone
4543 (ketone), ethanone, methanediyl (methylene bridge), or methine.
4644 (b) Penalty Group 2-A consists of any material, compound,
4745 mixture, or preparation that contains any quantity of a natural or
4846 synthetic chemical substance, including its salts, isomers, and
4947 salts of isomers, listed by name in this subsection or contained
5048 within one of the structural classes defined in this subsection:
5149 (1) WIN-55,212-2;
5250 (2) Cyclohexylphenol: any compound [that is a
5351 cannabinoid receptor agonist and mimics the pharmacological effect
5452 of naturally occurring cannabinoids, including:
5553 [naphthoylindoles structurally derived from
5654 3-(1-naphthoyl)indole by substitution at the nitrogen atom of the
5755 indole ring by alkyl, alkenyl, cycloalkylmethyl, cycloalkylethyl,
5856 or 2-(4-morpholinyl)ethyl, whether or not further substituted in
5957 the indole ring to any extent, whether or not substituted in the
6058 napthyl ring to any extent, including:

280278 substituted to any extent, including:
281279 Naphthoyl benzothiazole; and
282280 (8) any compound containing a core component
283281 substituted at the 9-position to any extent, and substituted at the
284282 3-position with a link component attached to a group A component,
285283 whether or not the core component or group A component are further
286284 substituted to any extent, including:
287285 Naphthoylcarbazole (EG-018) [and
288286 [WIN-55,212-2].
289287 SECTION 3. Section 481.106, Health and Safety Code, is
290288 amended to read as follows:
291289 Sec. 481.106. CLASSIFICATION OF CONTROLLED SUBSTANCE
292290 ANALOGUE. For the purposes of the prosecution of an offense under
293291 this subchapter involving the manufacture, delivery, or possession
294292 of a controlled substance, Penalty Groups 1, 1-A, [and] 2, and 2-A
295293 include a controlled substance analogue that:
296294 (1) has a chemical structure substantially similar to
297295 the chemical structure of a controlled substance listed in the
298296 applicable penalty group; or
299297 (2) is specifically designed to produce an effect
300298 substantially similar to, or greater than, a controlled substance
301299 listed in the applicable penalty group.
302300 SECTION 4. The change in law made by this Act applies only
303301 to an offense committed on or after the effective date of this Act.
304302 An offense committed before the effective date of this Act is
305303 governed by the law in effect on the date the offense was committed,
306304 and the former law is continued in effect for that purpose. For
307305 purposes of this section, an offense was committed before the
308306 effective date of this Act if any element of the offense occurred
309307 before that date.
310308 SECTION 5. This Act takes effect September 1, 2015.
