55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of Texas Emissions Reduction Plan funds for the
88 diesel emissions reduction incentive program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 386.252(a), Health and Safety Code, is
1111 amended to read as follows:
1212 (a) Money in the fund may be used only to implement and
1313 administer programs established under the plan. Money
1414 appropriated to the commission to be used for the programs under
1515 Section 386.051(b) shall be allocated as follows:
1616 (1) not more than four percent may be used for the
1717 clean school bus program under Chapter 390;
1818 (2) not more than three percent may be used for the new
1919 technology implementation grant program under Chapter 391, from
2020 which at least $1 million will be set aside for electricity storage
2121 projects related to renewable energy;
2222 (3) five percent shall be used for the clean fleet
2323 program under Chapter 392;
2424 (4) not more than $3 million may be used by the
2525 commission to fund a regional air monitoring program in commission
2626 Regions 3 and 4 to be implemented under the commission's oversight,
2727 including direction regarding the type, number, location, and
2828 operation of, and data validation practices for, monitors funded by
2929 the program through a regional nonprofit entity located in North
3030 Texas having representation from counties, municipalities, higher
3131 education institutions, and private sector interests across the
3232 area;
3333 (5) not less than 16 percent shall be used for the
3434 Texas natural gas vehicle grant program under Chapter 394;
3535 (6) not more than five percent may be used to provide
3636 grants for natural gas fueling stations under the clean
3737 transportation triangle program under Section 394.010;
3838 (7) not more than five percent may be used for the
3939 Texas alternative fueling facilities program under Chapter 393;
4040 (8) a specified amount may be used each year to support
4141 research related to air quality as provided by Chapter 387;
4242 (9) not more than $200,000 may be used for a health
4343 effects study;
4444 (10) $500,000 is to be deposited in the state treasury
4545 to the credit of the clean air account created under Section
4646 382.0622 to supplement funding for air quality planning activities
4747 in affected counties;
4848 (11) at least $4 million and up to four percent to a
4949 maximum of $7 million, whichever is greater, is allocated to the
5050 commission for administrative costs;
5151 (12) at least two percent and up to five percent of the
5252 fund is to be used by the commission for the drayage truck incentive
5353 program established under Subchapter D-1;
5454 (13) not more than five percent may be used for the
5555 light-duty motor vehicle purchase or lease incentive program
5656 established under Subchapter D;
5757 (14) not more than $216,000 is allocated to the
5858 commission to contract with the Energy Systems Laboratory at the
5959 Texas Engineering Experiment Station annually for the development
6060 and annual computation of creditable statewide emissions
6161 reductions obtained through wind and other renewable energy
6262 resources for the state implementation plan;
6363 (15) 1.5 percent of the money in the fund is allocated
6464 for administrative costs incurred by the laboratory; and
6565 (16) at least 50 percent, and any remaining balance as
6666 determined by the commission, [the balance] is to be used by the
6767 commission for the diesel emissions reduction incentive program
6868 under Subchapter C [as determined by the commission].
6969 SECTION 2. This Act takes effect September 1, 2015.
