44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to authorization for a school district board of trustees
77 to grant charters for the establishment of certain charter schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 12, Education Code, is
1010 amended by adding Section 12.0523 to read as follows:
1111 Sec. 12.0523. CHARTER OPERATED BY DISTRICT. (a) The
1212 commissioner by rule shall authorize a school district board of
1313 trustees to grant a charter for the establishment of a charter
1414 school in accordance with this section.
1515 (b) A charter school established under this section is
1616 administered by the superintendent of the school district granting
1717 the charter. The governing body of the charter school is the board
1818 of trustees of the school district granting the charter.
1919 (c) The commissioner shall adopt rules for the operation of
2020 a charter school established under this section relating to:
2121 (1) a process through which the charter school
2222 requests and obtains from the State Board of Education waivers from
2323 otherwise applicable provisions of this code;
2424 (2) a school district's ability to sell or otherwise
2525 dispose of the charter;
2626 (3) intellectual property rights belonging to a school
2727 district that established the charter school;
2828 (4) a student enrollment process;
2929 (5) employment of teachers; and
3030 (6) the allocation of funding generated by students
3131 attending the charter school.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2015.
