66 AN ACT
77 relating to certain required reports, plans, and other documents
88 prepared by state agencies and institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.034(e), Education Code, is amended to
1111 read as follows:
1212 (e) The board of directors shall:
1313 (1) employ a director for the center; and
1414 (2) establish priorities for the center's activities[;
1515 and
1616 [(3) report annually on the operation, projects, and
1717 fiscal affairs of the center to the State Board of Education and the
1818 membership of the center].
1919 SECTION 2. Section 39.263(c), Education Code, is amended to
2020 read as follows:
2121 (c) The commissioner shall select annually schools and
2222 districts qualified to receive successful school awards for their
2323 performance [and report the selections to the governor and the
2424 State Board of Education].
2525 SECTION 3. Section 51.752(h), Education Code, is amended to
2626 read as follows:
2727 (h) If the legislature fails to appropriate funds for the
2828 operation of the Educational Economic Policy Center, the
2929 Legislative Budget Board shall perform the duties of the committee
3030 under this subchapter. [The board shall make the annual reports
3131 required by Subsection (g) to the presiding officers of the
3232 standing committees of the senate and the house of representatives
3333 with primary jurisdiction over the public school system.]
3434 SECTION 4. Section 61.0762(a), Education Code, is amended
3535 to read as follows:
3636 (a) To [implement the college readiness and success
3737 strategic action plan adopted under Section 61.0761 and to] enhance
3838 the success of students at institutions of higher education, the
3939 board by rule shall:
4040 (1) develop higher education bridge programs in the
4141 subject areas of mathematics, science, social science, or English
4242 language arts to increase student success by reducing the need for
4343 developmental education;
4444 (2) develop incentive programs for institutions of
4545 higher education that implement research-based, innovative
4646 developmental education initiatives;
4747 (3) develop a pilot program to award grants to
4848 institutions of higher education for intensive programs designed to
4949 address the needs of students at risk of dropping out of college;
5050 (4) develop professional development programs for
5151 faculty of institutions of higher education on college readiness
5252 standards and the implications of such standards on instruction;
5353 and
5454 (5) develop other programs as determined by the board
5555 that support the participation and success goals in "Closing the
5656 Gaps," the state's master plan for higher education.
5757 SECTION 5. Section 88.526(a), Education Code, is amended to
5858 read as follows:
5959 (a) The director shall prepare an annual report on equine
6060 research funded under this subchapter. The director shall
6161 distribute the report to [the Texas Racing Commission and] members
6262 of the Texas horse racing industry. The director shall make copies
6363 of the report available to interested parties.
6464 SECTION 6. Section 72.084, Government Code, is amended to
6565 read as follows:
6666 Sec. 72.084. COURT OF APPEALS. Each month, a [A] court of
6767 appeals shall [annually] report to the office:
6868 (1) the number of cases filed with the court during the
6969 reporting month [year];
7070 (2) the number of cases disposed of by the court during
7171 the reporting month [year];
7272 (3) for active cases on the docket of the court on the
7373 reporting date, the average number of days from the date of
7474 submission of the case to the court until the reporting date; and
7575 (4) for each case disposed of during the reporting
7676 month [year] by the court, the number of days from the date of
7777 submission of the case to the court until the date of disposition of
7878 the case by the court.
7979 SECTION 7. Section 531.02111(e), Government Code, is
8080 amended to read as follows:
8181 (e) Not later than December 1 of each even-numbered year,
8282 the commission shall submit the report to the governor, the
8383 lieutenant governor, the speaker of the house of representatives,
8484 the presiding officer of each standing committee of the senate and
8585 house of representatives having jurisdiction over health and human
8686 services issues, and the state auditor[, and the comptroller].
8787 SECTION 8. Section 531.02112(c), Government Code, is
8888 amended to read as follows:
8989 (c) The commission shall submit the report to the governor,
9090 legislature, and state auditor[, and comptroller].
9191 SECTION 9. Section 531.055(a), Government Code, is amended
9292 to read as follows:
9393 (a) Each health and human services agency, the Texas
9494 Correctional Office [Council] on Offenders with Medical or Mental
9595 Impairments, the Texas Department of Criminal Justice, the Texas
9696 Department of Housing and Community Affairs, [the Texas Education
9797 Agency,] the Texas Workforce Commission, and the Texas Juvenile
9898 Justice Department [Youth Commission] shall adopt a joint
9999 memorandum of understanding to promote a system of local-level
100100 interagency staffing groups to coordinate services for persons
101101 needing multiagency services.
102102 SECTION 10. Section 614.072(f), Government Code, is amended
103103 to read as follows:
104104 (f) The director shall prepare an annual written report on
105105 the activity, status, and effectiveness of the fund and shall
106106 submit the report to the lieutenant governor and[,] the speaker of
107107 the house of representatives[, and the comptroller] before
108108 September 1 of each year.
109109 SECTION 11. Section 772.009, Government Code, is amended by
110110 amending Subsection (g) and adding Subsection (g-1) to read as
111111 follows:
112112 (g) Each state agency other than an institution of higher
113113 education shall file an annual report with the grant writing team
114114 concerning the agency's efforts to acquire [in acquiring] available
115115 discretionary federal funds during the preceding state fiscal
116116 year. The grant writing team shall establish guidelines for
117117 information included in the annual report required by this
118118 subsection [section].
119119 (g-1) The grant writing team shall:
120120 (1) evaluate the effectiveness of each agency in
121121 acquiring discretionary federal funds during the preceding state
122122 fiscal year;
123123 (2) [and shall] report the findings of the evaluation
124124 to the governor and the Legislative Budget Board; and
125125 (3) publish the report on the office of the governor's
126126 Internet website.
127127 SECTION 12. Section 2056.002(d), Government Code, is
128128 amended to read as follows:
129129 (d) A state agency shall send two copies of each plan to both
130130 the Legislative Reference Library and the state publications
131131 clearinghouse of the Texas State Library and one copy each to:
132132 (1) the governor;
133133 (2) the lieutenant governor;
134134 (3) the speaker of the house of representatives;
135135 (4) the Legislative Budget Board;
136136 (5) the Sunset Advisory Commission;
137137 (6) the state auditor; and
138138 (7) [the comptroller; and
139139 [(8)] the Department of Information Resources.
140140 SECTION 13. Section 2056.009(b), Government Code, is
141141 amended to read as follows:
142142 (b) The state plan shall be sent to the governor, lieutenant
143143 governor, [comptroller,] and each member of the legislature not
144144 later than the seventh working day of each regular session of the
145145 legislature.
146146 SECTION 14. Section 2165.055, Government Code, as amended
147147 by Chapters 1153 (S.B. 211) and 1312 (S.B. 59), Acts of the 83rd
148148 Legislature, Regular Session, 2013, is reenacted and amended to
149149 read as follows:
150150 Sec. 2165.055. REPORT ABOUT IMPROVEMENTS AND REPAIRS. Not
151151 later than December 1 of each even-numbered year, the commission
152152 [on July 1 of each even-numbered year] shall [electronically submit
153153 a] report to the governor[, lieutenant governor, speaker of the
154154 house of representatives, comptroller, and Legislative Budget
155155 Board on]:
156156 (1) all improvements and repairs that have been made,
157157 with an itemized account of receipts and expenditures; and
158158 (2) the condition of all property under its control,
159159 with an estimate of needed improvements and repairs.
160160 SECTION 15. Section 2166.101(d), Government Code, as
161161 amended by Chapters 1153 (S.B. 211) and 1312 (S.B. 59), Acts of the
162162 83rd Legislature, Regular Session, 2013, is reenacted and amended
163163 to read as follows:
164164 (d) The commission shall summarize its findings on the
165165 status of state-owned buildings and current information on
166166 construction costs and include the summary in the commission's
167167 master facilities plan required under Section 2166.102 [in an
168168 electronically submitted report to the governor, lieutenant
169169 governor, speaker of the house of representatives, comptroller, and
170170 Legislative Budget Board not later than July 1 of each
171171 even-numbered year].
172172 SECTION 16. Section 2166.103(b), Government Code, as
173173 amended by Chapters 1153 (S.B. 211) and 1312 (S.B. 59), Acts of the
174174 83rd Legislature, Regular Session, 2013, is reenacted and amended
175175 to read as follows:
176176 (b) The [Not later than July 1 of each even-numbered year,]
177177 commission shall identify [electronically submit to the governor,
178178 the lieutenant governor, the speaker of the house of
179179 representatives, the comptroller, and the Legislative Budget Board
180180 a report identifying] counties in which more than 50,000 square
181181 feet of usable office space is needed and make recommendations for
182182 meeting that need. The commission may recommend leasing or
183183 purchasing and renovating one or more existing buildings or
184184 constructing one or more buildings. The commission shall include
185185 the commission's findings and recommendations in the commission's
186186 master facilities plan required under Section 2166.102.
187187 SECTION 17. Section 2205.041, Government Code, is amended
188188 to read as follows:
189189 Sec. 2205.041. AIRCRAFT USE FORM. (a) The Texas Department
190190 of Transportation [Legislative Budget Board, in cooperation with
191191 the board,] shall prescribe:
192192 (1) an annual aircraft use form for gathering
193193 information about the use of state-operated aircraft, including the
194194 extent to which and the methods by which the goal provided by
195195 Section 2205.031(b) is being met; and
196196 (2) procedures for each state agency that operates an
197197 aircraft for sending the form to the department [board and the
198198 Legislative Budget Board].
199199 (b) The aircraft use form must request the following
200200 information about each aircraft a state agency operates:
201201 (1) a description of the aircraft;
202202 (2) the date purchased or leased and the purchase
203203 price or lease cost;
204204 (3) the number of annual hours flown;
205205 (4) the annual operating costs;
206206 (5) the number of flights and the destinations;
207207 (6) the travel logs prepared under Section 2205.039;
208208 and
209209 (7) any other information the Texas Department of
210210 Transportation [Legislative Budget Board] requires to document the
211211 proper or cost-efficient use of the aircraft.
212212 SECTION 18. The following provisions are repealed:
213213 (1) Section 51.752(g), Education Code;
214214 (2) Section 61.0761, Education Code;
215215 (3) Section 109.75(c), Education Code;
216216 (4) Section 761.005, Government Code;
217217 (5) Section 2166.409, Government Code;
218218 (6) Section 101.0252, Human Resources Code; and
219219 (7) Section 162.501(c), Tax Code.
220220 SECTION 19. This Act takes effect September 1, 2015.
