66 AN ACT
77 relating to the definition of serious mental illness for purposes
88 of certain group health benefit plans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1355.001, Insurance Code, is amended by
1111 amending Subdivision (1) and adding Subdivision (5) to read as
1212 follows:
1313 (1) "Serious mental illness" means the following
1414 psychiatric illnesses as defined by the American Psychiatric
1515 Association in the Diagnostic and Statistical Manual of Mental
1616 Disorders (DSM), fifth edition, or a later edition adopted by the
1717 commissioner:
1818 (A) bipolar disorders (hypomanic, manic,
1919 depressive, and mixed);
2020 (B) depression in childhood and adolescence;
2121 (C) major depressive disorders (single episode
2222 or recurrent);
2323 (D) obsessive-compulsive disorders;
2424 (E) paranoid and other psychotic disorders;
2525 (F) posttraumatic stress disorder;
2626 (G) schizo-affective disorders (bipolar or
2727 depressive); and
2828 (H) [(G)] schizophrenia.
2929 (5) "Posttraumatic stress disorder" means a disorder
3030 that:
3131 (A) meets the diagnostic criteria for
3232 posttraumatic stress disorder specified by the American
3333 Psychiatric Association in the Diagnostic and Statistical Manual of
3434 Mental Disorders, fifth edition, or a later edition adopted by the
3535 commissioner; and
3636 (B) results in an impairment of a person's
3737 functioning in the person's community, employment, family, school,
3838 or social group.
3939 SECTION 2. The change in law made by this Act applies only
4040 to a group health benefit plan that is delivered, issued for
4141 delivery, or renewed on or after January 1, 2016. A group health
4242 benefit plan that is delivered, issued for delivery, or renewed
4343 before January 1, 2016, is governed by the law as it existed
4444 immediately before the effective date of this Act, and that law is
4545 continued in effect for that purpose.
4646 SECTION 3. This Act takes effect September 1, 2015.
