| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 42.006, Education Code, is amended by | |
| 11 | 11 | adding Subsection (a-2) to read as follows: | |
| 12 | 12 | (a-2) The commissioner by rule shall require each school | |
| 13 | 13 | district and open-enrollment charter school to report through the | |
| 14 | 14 | Public Education Information Management System information | |
| 15 | 15 | regarding the availability of school counselors at each campus. The | |
| 16 | 16 | commissioner's rules shall require a district or school to report | |
| 17 | 17 | the number of full-time equivalent school counselors providing | |
| 18 | 18 | counseling services at a campus. For purposes of this subsection, | |
| 19 | 19 | "full-time equivalent school counselor" means 40 hours of | |
| 20 | 20 | counseling services a week. The agency shall maintain the | |
| 21 | 21 | information provided in accordance with this subsection. | |
| 22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2015. |
