| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 341, Health and Safety Code, is amended |
|---|
| 10 | 10 | | by adding Subchapter G to read as follows: |
|---|
| 11 | 11 | | SUBCHAPTER G. REGULATION OF PETROLEUM COKE STORAGE AND TRANSPORT |
|---|
| 12 | 12 | | Sec. 341.101. DEFINITIONS. In this subchapter: |
|---|
| 13 | 13 | | (1) "Fugitive dust" means any solid particulate matter |
|---|
| 14 | 14 | | that becomes airborne by natural or human activity. The term does |
|---|
| 15 | 15 | | not include exhaust from a combustion engine or particulate matter |
|---|
| 16 | 16 | | emitted from a properly permitted exhaust stack equipped with a |
|---|
| 17 | 17 | | functioning pollution control device. |
|---|
| 18 | 18 | | (2) "Petroleum coke" means a solid, carbonaceous |
|---|
| 19 | 19 | | residue produced from a coker after cracking and distillation in a |
|---|
| 20 | 20 | | petroleum refining operation, including a residue produced by |
|---|
| 21 | 21 | | petroleum upgrading. |
|---|
| 22 | 22 | | (3) "Political subdivision" means a municipality, |
|---|
| 23 | 23 | | county, or special district. |
|---|
| 24 | 24 | | Sec. 341.102. REGULATION BY POLITICAL SUBDIVISION. (a) To |
|---|
| 25 | 25 | | prevent fugitive dust from petroleum coke, a political subdivision |
|---|
| 26 | 26 | | may adopt regulations governing petroleum coke storage or transport |
|---|
| 27 | 27 | | in the jurisdiction of the political subdivision. |
|---|
| 28 | 28 | | (b) Regulations under this section may provide for: |
|---|
| 29 | 29 | | (1) storage facility setback requirements; |
|---|
| 30 | 30 | | (2) fugitive dust control measures, including |
|---|
| 31 | 31 | | enclosure requirements; and |
|---|
| 32 | 32 | | (3) penalty provisions for noncompliance with |
|---|
| 33 | 33 | | regulations. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2015. |
