77 relating to the manufacture, sale, distribution, possession, and
88 use of drugs not approved by the United States Food and Drug
99 Administration and the false representation that a substance is a
1010 drug approved by the United States Food and Drug Administration;
1111 creating criminal offenses.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 431, Health and Safety Code, is amended
1414 by adding Subchapter E-1 to read as follows:
1515 SUBCHAPTER E-1. DRUGS NOT APPROVED BY THE UNITED STATES FOOD AND
1616 DRUG ADMINISTRATION
1717 Sec. 431.121. DEFINITION. In this subchapter, "unapproved
1818 drug" means a drug that is:
1919 (1) unsafe for self-medication;
2020 (2) not approved by the United States Food and Drug
2121 Administration; and
2222 (3) not listed in Schedules I through V or Penalty
2323 Groups 1 through 4 of Chapter 481.
2424 Sec. 431.122. APPLICABILITY. (a) This subchapter does not
2525 apply to any drug, regardless of whether approved by the United
2626 States Food and Drug Administration, that is manufactured,
2727 packaged, distributed, or possessed for use in pharmaceutical
2828 compounding by a licensed pharmacist, physician, or registered
2929 outsourcing facility in compliance with federal law.
3030 (b) This subchapter does not apply to a foreign drug not
3131 approved by the United States Food and Drug Administration that is
3232 imported in compliance with:
3333 (1) federal or state law; or
3434 (2) an announcement by the United States Food and Drug
3535 Administration authorizing the import of the drug, including for
3636 clinical research, drug shortages, and pandemic preparedness and
3737 response.
3838 (c) This subchapter does not apply to the dispensation or
3939 sale of a drug according to a prescription issued by a practitioner.
4040 Sec. 431.123. OFFENSE: MANUFACTURE, SALE, OR DISTRIBUTION
4141 OF UNAPPROVED DRUG. (a) A person commits an offense if the person
4242 manufactures, sells, or distributes an unapproved drug.
4343 (b) An offense under this section is a state jail felony.
4444 Sec. 431.124. OFFENSE: MISREPRESENTATION OF SUBSTANCE OR
4545 DRUG. (a) A person commits an offense if the person falsely
4646 represents to an individual to whom the actor or another person is
4747 selling or distributing a substance that the substance is:
4848 (1) a drug approved for human use by the United States
4949 Food and Drug Administration; or
5050 (2) intended for use in the cure, mitigation,
5151 treatment, or prevention of disease in humans.
5252 (b) A person commits an offense if the person falsely
5353 represents to an individual to whom the actor or another person is
5454 selling or distributing a drug that is approved for human use by the
5555 United States Food and Drug Administration that the drug is:
5656 (1) a different drug approved for human use by the
5757 United States Food and Drug Administration; or
5858 (2) intended for use in the cure, mitigation,
5959 treatment, or prevention of a disease in humans when the drug is not
6060 approved or used in clinical practice for that purpose.
6161 (c) An offense under Subsection (a) is a state jail felony,
6262 except that if the substance is an unapproved drug, the offense is a
6363 felony of the third degree.
6464 (d) An offense under Subsection (b) is a state jail felony,
6565 except that if the drug may be dispensed only by prescription or is
6666 not approved for use in humans, the offense is a felony of the third
6767 degree.
6868 Sec. 431.125. OFFENSE: POSSESSION OR USE OF UNAPPROVED
6969 DRUG. (a) A person commits an offense if the person possesses or
7070 uses an unapproved drug.
7171 (b) An offense under this section is a Class A misdemeanor.
7272 (c) It is a defense to prosecution under this section that:
7373 (1) the actor obtained the unapproved drug from a
7474 practitioner, pharmacist, or other person authorized to dispense
7575 prescription drugs; and
7676 (2) the person dispensing the unapproved drug made the
7777 representation to the person that the drug was approved by the
7878 United States Food and Drug Administration for prescription use.
7979 Sec. 431.126. EFFECT ON OTHER LAWS. A person who is subject
8080 to prosecution under this subchapter or other law may be prosecuted
8181 under either or both laws.
8282 SECTION 2. This Act takes effect September 1, 2015.
