55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the recognition of certain employment authorizations
88 granted by federal executive action.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 2, Labor Code, is amended by
1111 adding Chapter 55 to read as follows:
1212 CHAPTER 55. EMPLOYMENT AUTHORIZATIONS
1313 Sec. 55.001. CERTAIN EMPLOYMENT AUTHORIZATIONS INVALID.
1414 (a) The employment authorization of a foreign national that was
1515 granted under a federal deferred action program created by
1616 executive order, or an agency rule or policy, or a similar measure
1717 adopted by an official or entity within the executive branch of the
1818 federal government, is not valid or enforceable in this state if the
1919 order, rule, policy, or measure exceeds the authority granted to
2020 the executive branch by the United States Constitution and was not
2121 ratified by the legislative branch of the federal government.
2222 (b) An employer may not employ a person granted an
2323 employment authorization described by Subsection (a) who is not
2424 otherwise lawfully present in the United States.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2015.
