9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subtitle B, Title 2, Labor Code, is amended by |
---|
11 | 11 | | adding Chapter 55 to read as follows: |
---|
12 | 12 | | CHAPTER 55. EMPLOYMENT AUTHORIZATIONS |
---|
13 | 13 | | Sec. 55.001. CERTAIN EMPLOYMENT AUTHORIZATIONS INVALID. |
---|
14 | 14 | | (a) The employment authorization of a foreign national that was |
---|
15 | 15 | | granted under a federal deferred action program created by |
---|
16 | 16 | | executive order, or an agency rule or policy, or a similar measure |
---|
17 | 17 | | adopted by an official or entity within the executive branch of the |
---|
18 | 18 | | federal government, is not valid or enforceable in this state if the |
---|
19 | 19 | | order, rule, policy, or measure exceeds the authority granted to |
---|
20 | 20 | | the executive branch by the United States Constitution and was not |
---|
21 | 21 | | ratified by the legislative branch of the federal government. |
---|
22 | 22 | | (b) An employer may not employ a person granted an |
---|
23 | 23 | | employment authorization described by Subsection (a) who is not |
---|
24 | 24 | | otherwise lawfully present in the United States. |
---|
25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
---|
26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
---|
27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
---|
29 | 29 | | Act takes effect September 1, 2015. |
