77 relating to the method of returning a ballot to be voted by mail.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 86.006, Election Code, is amended by
1010 amending Subsection (a) and adding Subsection (a-1) to read as
1111 follows:
1212 (a) A marked ballot voted under this chapter must be
1313 returned to the early voting clerk in the official carrier
1414 envelope. The carrier envelope may be delivered in another
1515 envelope and must be transported and delivered only by:
1616 (1) mail;
1717 (2) [or by] common or contract carrier; or
1818 (3) subject to Subsection (a-1), in-person delivery by
1919 the voter who voted the ballot.
2020 (a-1) The voter may deliver a marked ballot in person to the
2121 early voting clerk's office only while the polls are open on
2222 election day. A voter who delivers a marked ballot in person must
2323 present an acceptable form of identification described by Section
2424 63.0101.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2015.
