66 AN ACT
77 relating to authorization by the Texas Higher Education
88 Coordinating Board for certain public junior colleges to offer
99 early childhood education baccalaureate degree programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 130.0012, Education Code, is amended by
1212 adding Subsections (b-1), (b-2), and (g-1) and amending Subsection
1313 (g) to read as follows:
1414 (b-1) The coordinating board shall authorize a
1515 baccalaureate degree program in early childhood education at each
1616 public junior college located in a county with a population of
1717 greater than one million if:
1818 (1) the county has a demonstrated initial need for at
1919 least 3,000 early childhood educators;
2020 (2) the degree program curriculum is approved by the
2121 independent school districts located in the county that
2222 collectively represent at least 51 percent of the student
2323 population enrolled in kindergarten through 12th grade; and
2424 (3) one of the following:
2525 (A) before November 1, 2015, a regional public
2626 university located in the county or an immediately adjacent county
2727 is unable to obtain the approval of the independent school
2828 districts located in the county that collectively represent at
2929 least 51 percent of the student population enrolled in kindergarten
3030 through 12th grade for a detailed plan to:
3131 (i) expand degree output of early childhood
3232 and elementary certified teachers to collectively meet the
3333 three-year average hiring demands of the independent school
3434 districts located in the county and immediately adjacent counties,
3535 including producing more prekindergarten teachers to support the
3636 planned increases in prekindergarten enrollment for all public
3737 schools;
3838 (ii) implement an early childhood education
3939 curriculum; and
4040 (iii) fund the expansion of current or
4141 development of new early childhood education programs, which does
4242 not include state funding for new facilities; or
4343 (B) before September 1, 2017, a regional public
4444 university that received the approval of independent school
4545 districts as described by Paragraph (A) is unable to demonstrate:
4646 (i) the necessary current student
4747 enrollment to produce sufficient early childhood and elementary
4848 certified teachers within the next four years to meet the existing
4949 hiring demands of the independent school districts located in the
5050 county and immediately adjacent counties based on historical
5151 three-year averages, including producing more prekindergarten
5252 teachers to support the planned increases in prekindergarten
5353 enrollment for all public schools; and
5454 (ii) implementation of an early childhood
5555 education curriculum meeting the expressed needs of the independent
5656 school districts located in the county that collectively represent
5757 at least 51 percent of the student population enrolled in
5858 kindergarten through 12th grade.
5959 (b-2) The coordinating board may not subsequently terminate
6060 authorization to offer an early childhood baccalaureate degree
6161 program granted under Subsection (b-1) on the ground that
6262 implementation of the degree program reduces the workforce need to
6363 a level that is below the minimal threshold specified in Subsection
6464 (b-1)(1).
6565 (g) Except as provided by Subsection (g-1), in [In] its
6666 recommendations to the legislature relating to state funding for
6767 public junior colleges, the coordinating board shall recommend that
6868 a public junior college receive substantially the same state
6969 support for junior-level and senior-level courses offered under
7070 this section as that provided to a general academic teaching
7171 institution for substantially similar courses. In determining the
7272 contact hours attributable to students enrolled in a junior-level
7373 or senior-level course offered under this section used to determine
7474 a public junior college's proportionate share of state
7575 appropriations under Section 130.003, the coordinating board shall
7676 weigh those contact hours as necessary to provide the junior
7777 college the appropriate level of state support to the extent state
7878 funds for those courses are included in the appropriations. This
7979 subsection does not prohibit the legislature from directly
8080 appropriating state funds to support junior-level and senior-level
8181 courses offered under this section.
8282 (g-1) A degree program created under Subsection (b-1) may be
8383 funded only by a public junior college's proportionate share of
8484 state appropriations under Section 130.003, local funds, and
8585 private sources. This subsection does not require the legislature
8686 to appropriate state funds to support a degree program created
8787 under Subsection (b-1).
8888 SECTION 2. This Act takes effect September 1, 2015.
