99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to fees charged by the Coastal Bend Groundwater
1212 Conservation District.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 8829.151, Special District Local Laws
1515 Code, is amended to read as follows:
1616 Sec. 8829.151. DISTRICT REVENUE AND FEES. To accomplish
1717 the regulatory goals of the district, and to pay the district's
1818 maintenance and operating costs, the district may:
1919 (1) impose an ad valorem tax at a rate not to exceed
2020 five cents for each $100 of taxable value of property in the
2121 district;
2222 (2) assess [general] production fees as authorized by
2323 Section 36.205, Water Code;
2424 (3) solicit and accept grants from any public or
2525 private source; [and]
2626 (4) assess an export [a transfer] fee on water
2727 exported from the district in an amount not to exceed 150 percent of
2828 the maximum wholesale water rate charged by the City of Houston; and
2929 (5) assess other fees authorized by Chapter 36, Water
3030 Code.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2015.
