| 11 | 11 | | relating to the period of time allowed for appointment of a board of |

| 12 | 12 | | managers for a school district. |

| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 39.112, Education Code, is amended by |
|---|
| 15 | 15 | | amending Subsection (e) and adding Subsection (f) to read as |
|---|
| 16 | 16 | | follows: |
|---|
| 17 | 17 | | (e) Except as otherwise provided by Subsection (f), at [At] |
|---|
| 18 | 18 | | the direction of the commissioner but not later than the second |
|---|
| 19 | 19 | | anniversary of the date the board of managers of a district was |
|---|
| 20 | 20 | | appointed, the board of managers shall order an election of members |
|---|
| 21 | 21 | | of the district board of trustees. The election must be held on a |
|---|
| 22 | 22 | | uniform election date on which an election of district trustees may |
|---|
| 23 | 23 | | be held under Section 41.001, Election Code, that is at least 180 |
|---|
| 24 | 24 | | days after the date the election was ordered. On qualification of |
|---|
| 25 | 25 | | members for office, the board of trustees assumes all of the powers |
|---|
| 26 | 26 | | and duties assigned to a board of trustees by law, rule, or |
|---|
| 27 | 27 | | regulation. |
|---|
| 28 | 28 | | (f) If, before the second anniversary of the date the board |
|---|
| 29 | 29 | | of managers of a district was appointed, the commissioner |
|---|
| 30 | 30 | | determines that insufficient progress has been made toward |
|---|
| 31 | 31 | | improving the academic or financial performance of the district, |
|---|
| 32 | 32 | | the commissioner may extend the authority of the board of managers |
|---|
| 33 | 33 | | for a period of up to two additional years. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2015. |
