55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of a credit or charge card by certain state
88 agencies to make certain purchases.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 403.023, Government Code, is amended by
1111 adding Subsections (b-1) and (b-2) to read as follows:
1212 (b-1) Except as provided by Subsection (b-2), if the
1313 comptroller adopts rules authorized under Subsection (b), the rules
1414 must:
1515 (1) require a state agency in the executive branch of
1616 state government to use a credit or charge card to pay for all
1717 purchases unless the comptroller determines that another method of
1818 payment is more advantageous to the state; and
1919 (2) prohibit an employee of a state agency in the
2020 executive branch of state government from using a personal credit
2121 or charge card to pay for the state agency's purchases.
2222 (b-2) Subsection (b-1) does not apply to:
2323 (1) an institution of higher education as defined by
2424 Section 61.003, Education Code; or
2525 (2) the office of the governor.
2626 SECTION 2. Section 660.021, Government Code, is amended to
2727 read as follows:
2828 Sec. 660.021. RULES. (a) The comptroller shall adopt rules
2929 for the effective and efficient administration of this chapter and
3030 the travel provisions of the General Appropriations Act.
3131 (b) Except as provided by Subsection (c), the rules adopted
3232 by the comptroller under this section must require that if a state
3333 agency in the executive branch of state government participates in
3434 a program administered by the comptroller that allows the agency to
3535 use a credit or charge card to pay for travel expenses:
3636 (1) the agency shall use the credit or charge card to
3737 pay for travel expenses required for agency travel, unless the
3838 comptroller determines that another method of payment is more
3939 advantageous to the state; and
4040 (2) an employee of the agency may not use the
4141 employee's personal credit or charge card to pay for travel
4242 expenses required for agency travel.
4343 (c) Subsection (b) does not apply to:
4444 (1) an institution of higher education as defined by
4545 Section 61.003, Education Code; or
4646 (2) the office of the governor.
4747 SECTION 3. Subchapter B, Chapter 2171, Government Code, is
4848 amended by adding Section 2171.0521 to read as follows:
4949 Sec. 2171.0521. PAYMENT FOR TRAVEL SERVICES WITH CREDIT OR
5050 CHARGE CARD. (a) Except as provided by Subsection (b), if a state
5151 agency in the executive branch of state government participates in
5252 a program administered by the comptroller that allows the agency to
5353 use a credit or charge card to purchase travel services:
5454 (1) the agency shall use the credit or charge card to
5555 purchase travel services required for agency travel, unless the
5656 comptroller determines that another method of purchase is more
5757 advantageous to the state; and
5858 (2) an employee of the agency may not use the
5959 employee's personal credit or charge card to purchase travel
6060 services required for agency travel.
6161 (b) This section does not apply to:
6262 (1) an institution of higher education as defined by
6363 Section 61.003, Education Code; or
6464 (2) the office of the governor.
6565 SECTION 4. This Act takes effect immediately if it receives
6666 a vote of two-thirds of all the members elected to each house, as
6767 provided by Section 39, Article III, Texas Constitution. If this
6868 Act does not receive the vote necessary for immediate effect, this
6969 Act takes effect September 1, 2015.
