77 relating to standards for the Public Utility Commission of Texas to
88 grant or deny certain certificates of convenience and necessity.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.056, Utilities Code, is amended by
1111 adding Subsection (e) to read as follows:
1212 (e) In evaluating the need for a certificate for a
1313 transmission project that serves the ERCOT power region, the
1414 commission may not use a reliability standard that is more
1515 stringent than the reliability standards used by the National
1616 Electric Reliability Council.
1717 SECTION 2. This Act takes effect immediately if it receives
1818 a vote of two-thirds of all the members elected to each house, as
1919 provided by Section 39, Article III, Texas Constitution. If this
2020 Act does not receive the vote necessary for immediate effect, this
2121 Act takes effect September 1, 2015.
