8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter B, Chapter 61, Labor Code, is amended | |
10 | 10 | by adding Section 61.021 to read as follows: | |
11 | 11 | Sec. 61.021. GRATUITIES PAID TO TIPPED EMPLOYEES. (a) In | |
12 | 12 | this section, "tipped employee" has the meaning assigned by Section | |
13 | 13 | 62.052. | |
14 | 14 | (b) A gratuity paid to or left for a tipped employee is the | |
15 | 15 | property of the tipped employee. An employer may not collect or | |
16 | 16 | receive any portion of the gratuity for the purpose of compensating | |
17 | 17 | a credit card company for any financial services rendered on | |
18 | 18 | account of the gratuity. | |
19 | 19 | SECTION 2. Section 61.021, Labor Code, as added by this Act, | |
20 | 20 | applies only to a gratuity paid to or left for an employee on or | |
21 | 21 | after the effective date of this Act. | |
22 | 22 | SECTION 3. This Act takes effect September 1, 2015. |
