66 AN ACT
77 relating to the administration of housing funds set aside for
88 persons with disabilities through the homebuyer assistance
99 program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2306.111, Government Code, is amended by
1212 adding Subsection (c-3) to read as follows:
1313 (c-3) In administering funds that are set aside for persons
1414 with disabilities under Subsection (c)(2) and allocated through the
1515 homebuyer assistance program, the department:
1616 (1) may not require a person to enter into a contract
1717 to purchase a home before applying for or receiving funds allocated
1818 through the program; and
1919 (2) by rule shall implement a preapproval process
2020 under which a person:
2121 (A) before funds allocated through the program
2222 are made available, may establish eligibility to receive those
2323 funds; and
2424 (B) has an adequate period of at least 90 days in
2525 which to locate a home for purchase using funds made available under
2626 the program.
2727 SECTION 2. The Texas Department of Housing and Community
2828 Affairs shall adopt rules under Section 2306.111(c-3), Government
2929 Code, as added by this Act, not later than December 31, 2015.
3030 SECTION 3. The change in law made by this Act applies only
3131 to an application for housing funds that are administered through
3232 the homebuyer assistance program submitted to the Texas Department
3333 of Housing and Community Affairs on or after the date the rules
3434 adopted by the department under Section 2306.111(c-3), Government
3535 Code, as added by this Act, take effect. An application for housing
3636 funds submitted before the date the rules take effect is governed by
3737 the law in effect immediately before the effective date of this Act,
3838 and the former law is continued in effect for that purpose.
3939 SECTION 4. This Act takes effect September 1, 2015.
