| 8 | 8 | | persons with disabilities through the homebuyer assistance |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2306.111, Government Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (c-3) to read as follows: |
|---|
| 13 | 13 | | (c-3) In administering funds that are set aside for persons |
|---|
| 14 | 14 | | with disabilities under Subsection (c)(2) and allocated through the |
|---|
| 15 | 15 | | homebuyer assistance program, the department: |
|---|
| 16 | 16 | | (1) may not require a person to enter into a contract |
|---|
| 17 | 17 | | to purchase a home before applying for or receiving funds allocated |
|---|
| 18 | 18 | | through the program; and |
|---|
| 19 | 19 | | (2) by rule shall implement a preapproval process |
|---|
| 20 | 20 | | under which a person: |
|---|
| 21 | 21 | | (A) before funds allocated through the program |
|---|
| 22 | 22 | | are made available, may establish eligibility to receive those |
|---|
| 23 | 23 | | funds; and |
|---|
| 24 | 24 | | (B) has an adequate period of at least 90 days in |
|---|
| 25 | 25 | | which to locate a home for purchase using funds made available under |
|---|
| 26 | 26 | | the program. |

| 27 | 27 | | SECTION 2. The Texas Department of Housing and Community |
|---|
| 28 | 28 | | Affairs shall adopt rules under Section 2306.111(c-3), Government |
|---|
| 29 | 29 | | Code, as added by this Act, not later than December 31, 2015. |
|---|
| 30 | 30 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 31 | 31 | | to an application for housing funds that are administered through |
|---|
| 32 | 32 | | the homebuyer assistance program submitted to the Texas Department |
|---|
| 33 | 33 | | of Housing and Community Affairs on or after the date the rules |
|---|
| 34 | 34 | | adopted by the department under Section 2306.111(c-3), Government |
|---|
| 35 | 35 | | Code, as added by this Act, take effect. An application for housing |
|---|
| 36 | 36 | | funds submitted before the date the rules take effect is governed by |
|---|
| 37 | 37 | | the law in effect immediately before the effective date of this Act, |
|---|
| 38 | 38 | | and the former law is continued in effect for that purpose. |

| 39 | 39 | | SECTION 4. This Act takes effect September 1, 2015. |
