55 AN ACT
66 relating to the reimbursement of providers for the provision of
77 certain home telemonitoring services under the Medicaid program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 531.02164, Government Code, is amended
1010 by adding Subsection (c-1) to read as follows:
1111 (c-1) Notwithstanding Subsection (c)(1), the program
1212 required under this section must also provide that home
1313 telemonitoring services are available to pediatric patients with
1414 chronic or complex medical needs who:
1515 (1) are being concurrently treated by at least three
1616 medical specialists;
1717 (2) are medically dependent on technology;
1818 (3) are diagnosed with end-stage solid organ disease;
1919 or
2020 (4) require mechanical ventilation.
2121 SECTION 2. Section 531.02176, Government Code, is amended
2222 to read as follows:
2323 [Sec. 531.02176. EXPIRATION OF MEDICAID REIMBURSEMENT FOR
2424 PROVISION OF HOME TELEMONITORING SERVICES. Notwithstanding any
2525 other law, the commission may not reimburse providers under the
2626 Medicaid program for the provision of home telemonitoring services
2727 on or after September 1, 2015.]
2828 SECTION 3. The executive commissioner of the Health and
2929 Human Services Commission shall adopt the rules necessary to
3030 implement Section 531.02164(c-1), Government Code, as added by this
3131 Act, not later than December 1, 2015.
3232 SECTION 4. If before implementing any provision of this Act
3333 a state agency determines that a waiver, an amendment to an existing
3434 waiver, or another authorization from a federal agency is necessary
3535 for implementation of that provision, the agency affected by the
3636 provision shall request the waiver, amendment to the existing
3737 waiver, or other authorization and may delay implementing that
3838 provision until the waiver, amendment, or authorization is granted.
3939 SECTION 5. This Act takes effect September 1, 2015.
