| 6 | 6 | | relating to the reimbursement of providers for the provision of |

| 7 | 7 | | certain home telemonitoring services under the Medicaid program. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 531.02164, Government Code, is amended |
|---|
| 10 | 10 | | by adding Subsection (c-1) to read as follows: |
|---|
| 11 | 11 | | (c-1) Notwithstanding Subsection (c)(1), the program |
|---|
| 12 | 12 | | required under this section must also provide that home |
|---|
| 13 | 13 | | telemonitoring services are available to pediatric patients with |
|---|
| 14 | 14 | | chronic or complex medical needs who: |
|---|
| 15 | 15 | | (1) are being concurrently treated by at least three |
|---|
| 16 | 16 | | medical specialists; |
|---|
| 17 | 17 | | (2) are medically dependent on technology; |
|---|
| 18 | 18 | | (3) are diagnosed with end-stage solid organ disease; |
|---|
| 19 | 19 | | or |
|---|
| 20 | 20 | | (4) require mechanical ventilation. |
|---|
| 21 | 21 | | SECTION 2. Section 531.02176, Government Code, is amended |
|---|
| 22 | 22 | | to read as follows: |
|---|
| 23 | 23 | | [Sec. 531.02176. EXPIRATION OF MEDICAID REIMBURSEMENT FOR |
|---|
| 24 | 24 | | PROVISION OF HOME TELEMONITORING SERVICES. Notwithstanding any |
|---|
| 25 | 25 | | other law, the commission may not reimburse providers under the |
|---|
| 26 | 26 | | Medicaid program for the provision of home telemonitoring services |
|---|
| 27 | 27 | | on or after September 1, 2015.] |
|---|
| 28 | 28 | | SECTION 3. The executive commissioner of the Health and |
|---|
| 29 | 29 | | Human Services Commission shall adopt the rules necessary to |
|---|
| 30 | 30 | | implement Section 531.02164(c-1), Government Code, as added by this |
|---|
| 31 | 31 | | Act, not later than December 1, 2015. |
|---|
| 32 | 32 | | SECTION 4. If before implementing any provision of this Act |
|---|
| 33 | 33 | | a state agency determines that a waiver, an amendment to an existing |
|---|
| 34 | 34 | | waiver, or another authorization from a federal agency is necessary |
|---|
| 35 | 35 | | for implementation of that provision, the agency affected by the |
|---|
| 36 | 36 | | provision shall request the waiver, amendment to the existing |
|---|
| 37 | 37 | | waiver, or other authorization and may delay implementing that |
|---|
| 38 | 38 | | provision until the waiver, amendment, or authorization is granted. |
|---|
| 39 | 39 | | SECTION 5. This Act takes effect September 1, 2015. |
