55 AN ACT
66 relating to developing a program to provide telemedicine medical
77 services to certain children.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1010 is amended by adding Section 32.076 to read as follows:
1111 Sec. 32.076. PROGRAM FOR TELEMEDICINE MEDICAL SERVICES FOR
1212 CHILDREN WITH CHRONIC OR COMPLEX MEDICAL NEEDS. (a) In this
1313 section, "telemedicine medical service" means a health care service
1414 that is provided by a physician for purposes of patient assessment,
1515 diagnosis, consultation, or treatment, or for the transfer of
1616 medical data, and that requires the use of advanced
1717 telecommunications technology, other than telephone or facsimile
1818 technology, including:
1919 (1) compressed digital interactive video, audio, or
2020 data transmission;
2121 (2) clinical data transmission using computer imaging
2222 by way of still-image capture and store and forward; and
2323 (3) other technology that facilitates access to health
2424 care services or medical specialty expertise.
2525 (b) The department shall develop and implement a program to:
2626 (1) enable an eligible child described under
2727 Subsection (c) to receive medical assistance benefits for health
2828 care services provided in the child's residence through
2929 telemedicine medical services; and
3030 (2) provide reimbursement to a pediatric
3131 subspecialist who provides telemedicine medical services under
3232 Subdivision (1).
3333 (c) A child is eligible for inclusion in the program under
3434 this section if the child:
3535 (1) is a recipient of medical assistance; and
3636 (2) has been diagnosed with:
3737 (A) an end-stage solid organ disease; or
3838 (B) a condition that, as determined by department
3939 rule, requires:
4040 (i) mechanical ventilation;
4141 (ii) the child to be technology-dependent;
4242 or
4343 (iii) the child to be treated by three or
4444 more specialists.
4545 (d) The program must require that the health care services
4646 provided through telemedicine medical services:
4747 (1) are provided by a pediatric subspecialist who:
4848 (A) has clinical privileges at a tertiary
4949 pediatric health care system that is associated with an academic
5050 medical center; and
5151 (B) has previously treated the child in person;
5252 and
5353 (2) do not replace the health care services the child
5454 is otherwise receiving.
5555 (e) Not later than January 1, 2019, the department shall
5656 report to the legislature on the results of the program. The report
5757 must include:
5858 (1) an evaluation of the clinical outcomes of the
5959 program, including the program's success in reducing expected
6060 emergency department visits; and
6161 (2) the program's impact on medical costs.
6262 (f) The executive commissioner may adopt rules to implement
6363 this section.
6464 (g) This section expires January 1, 2021.
6565 SECTION 2. If before implementing any provision of this Act
6666 a state agency determines that a waiver or authorization from a
6767 federal agency is necessary for implementation of that provision,
6868 the agency affected by the provision shall request the waiver or
6969 authorization and may delay implementing that provision until the
7070 waiver or authorization is granted.
7171 SECTION 3. This Act takes effect September 1, 2015.
