7 | 7 | | relating to the delivery of mental health services and supports |
---|
8 | 8 | | under a system of care framework to minors who have or are at risk of |
---|
9 | 9 | | developing a serious emotional disturbance or who are at risk of |
---|
10 | 10 | | being removed from the minor's home. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
12 | 12 | | SECTION 1. Section 531.251, Government Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | Sec. 531.251. TEXAS SYSTEM OF CARE FRAMEWORK [CONSORTIUM]. |
---|
15 | 15 | | (a) In this section: |
---|
16 | 16 | | (1) "Minor" means an individual younger than 18 years |
---|
17 | 17 | | of age. |
---|
18 | 18 | | (2) "Serious emotional disturbance" means a mental, |
---|
19 | 19 | | behavioral, or emotional disorder of sufficient duration to result |
---|
20 | 20 | | in functional impairment that substantially interferes with or |
---|
21 | 21 | | limits a person's role or ability to function in family, school, or |
---|
22 | 22 | | community activities. |
---|
23 | 23 | | (3) "System of care framework" means a framework for |
---|
24 | 24 | | collaboration among state agencies, minors who have a serious |
---|
25 | 25 | | emotional disturbance or are at risk of developing a serious |
---|
26 | 26 | | emotional disturbance, and the families of those minors that |
---|
27 | 27 | | improves access to services and delivers effective community-based |
---|
28 | 28 | | services that are family-driven, youth- or young adult-guided, and |
---|
29 | 29 | | culturally and linguistically competent. |
---|
30 | 30 | | (b) The commission shall implement [form a consortium to |
---|
31 | 31 | | have responsibility for and oversight over] a [state] system of |
---|
32 | 32 | | care framework to develop local mental health systems of care in |
---|
33 | 33 | | communities for minors who are receiving residential mental health |
---|
34 | 34 | | services and supports or inpatient mental health hospitalization, |
---|
35 | 35 | | have or are at risk of developing a serious emotional disturbance, |
---|
36 | 36 | | or [who] are at risk of being removed from the minor's home and |
---|
37 | 37 | | placed in a more restrictive environment to receive mental health |
---|
38 | 38 | | services and supports, including an inpatient mental health |
---|
39 | 39 | | hospital, a residential treatment facility, or a facility or |
---|
40 | 40 | | program operated by the Department of Family and Protective |
---|
41 | 41 | | Services or an agency that is part of the juvenile justice system. |
---|
42 | 42 | | (c) [(a-1) The consortium must include: |
---|
43 | 43 | | [(1) representatives of the Department of State Health |
---|
44 | 44 | | Services, Department of Family and Protective Services, Health and |
---|
45 | 45 | | Human Services Commission's Medicaid program, Texas Education |
---|
46 | 46 | | Agency, Texas Juvenile Justice Department, and Texas Correctional |
---|
47 | 47 | | Office on Offenders with Medical or Mental Impairments; |
---|
48 | 48 | | [(2) one youth or young adult who has a serious |
---|
49 | 49 | | emotional disturbance and has received mental health services and |
---|
50 | 50 | | supports; or |
---|
51 | 51 | | [(3) a family member of a youth or young adult |
---|
52 | 52 | | described by Subdivision (2). |
---|
53 | 53 | | [(a-2) The consortium may coordinate with the Children's |
---|
54 | 54 | | Policy Council for the purposes of including the representation |
---|
55 | 55 | | required by Subsections (a-1)(2) and (3). |
---|
56 | 56 | | [(b)] The commission [and the consortium] shall: |
---|
57 | 57 | | (1) maintain a comprehensive plan for the delivery of |
---|
58 | 58 | | mental health services and supports to a minor and a minor's family |
---|
59 | 59 | | using a system of care framework, including best practices in the |
---|
60 | 60 | | financing, administration, governance, and delivery of those |
---|
61 | 61 | | services; |
---|
62 | 62 | | (2) enter memoranda of understanding with the |
---|
63 | 63 | | Department of State Health Services, the Department of Family and |
---|
64 | 64 | | Protective Services, the Texas Education Agency, the Texas Juvenile |
---|
65 | 65 | | Justice Department, and the Texas Correctional Office on Offenders |
---|
66 | 66 | | with Medical or Mental Impairments that specify the roles and |
---|
67 | 67 | | responsibilities of each agency in implementing the comprehensive |
---|
68 | 68 | | plan described by Subdivision (1) [implement strategies to expand |
---|
69 | 69 | | the use of system of care practices in the planning and delivery of |
---|
70 | 70 | | services throughout the state]; |
---|
71 | 71 | | (3) identify appropriate local, state, and federal |
---|
72 | 72 | | funding sources to finance infrastructure and mental health |
---|
73 | 73 | | services and supports needed to support state and local system of |
---|
74 | 74 | | care framework efforts; [and] |
---|
75 | 75 | | (4) develop an evaluation system to measure |
---|
76 | 76 | | cross-system performance and outcomes of state and local system of |
---|
77 | 77 | | care framework efforts; and |
---|
78 | 78 | | (5) in implementing the provisions of this section, |
---|
79 | 79 | | consult with stakeholders, including: |
---|
80 | 80 | | (A) minors who have or are at risk of developing a |
---|
81 | 81 | | serious emotional disturbance or young adults who received mental |
---|
82 | 82 | | health services and supports as a minor with or at risk of |
---|
83 | 83 | | developing a serious emotional disturbance; and |
---|
84 | 84 | | (B) family members of those minors or young |
---|
85 | 85 | | adults. |
---|
86 | 86 | | [(b-1) Not later than November 1 of each even-numbered year, |
---|
87 | 87 | | the consortium shall submit a report to the legislature and the |
---|
88 | 88 | | Council on Children and Families that contains an evaluation of the |
---|
89 | 89 | | outcomes of the Texas System of Care and recommendations on |
---|
90 | 90 | | strengthening state policies and practices that support local |
---|
91 | 91 | | systems of care, including recommendations relating to: |
---|
92 | 92 | | [(1) methods to increase access to effective and |
---|
93 | 93 | | coordinated services and supports; |
---|
94 | 94 | | [(2) methods to increase community capacity to |
---|
95 | 95 | | implement local systems of care through training and technical |
---|
96 | 96 | | assistance; |
---|
97 | 97 | | [(3) use of cross-system performance and outcome data |
---|
98 | 98 | | to make informed decisions at individual and system levels; and |
---|
99 | 99 | | [(4) strategies to maximize public and private funding |
---|
100 | 100 | | at the local, state, and federal levels.] |
---|
101 | 101 | | SECTION 2. Section 531.255, Government Code, is amended to |
---|
102 | 102 | | read as follows: |
---|
103 | 103 | | Sec. 531.255. EVALUATION. [(a)] The commission [and the |
---|
104 | 104 | | Department of State Health Services jointly] shall monitor the |
---|
105 | 105 | | implementation of a system of care framework under Section 531.251 |
---|
106 | 106 | | and adopt rules as necessary to facilitate or adjust that |
---|
107 | 107 | | implementation [progress of the communities that implement a local |
---|
108 | 108 | | system of care, including monitoring cost avoidance and the net |
---|
109 | 109 | | savings that result from implementing a local system of care]. |
---|
110 | 110 | | SECTION 3. This Act takes effect immediately if it receives |
---|
111 | 111 | | a vote of two-thirds of all the members elected to each house, as |
---|
112 | 112 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
113 | 113 | | Act does not receive the vote necessary for immediate effect, this |
---|
114 | 114 | | Act takes effect September 1, 2015. |
