55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of a select interim committee to undertake
88 a comprehensive review of the provision of public health care
99 services in this state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. CREATION OF SELECT INTERIM COMMITTEE. (a) A
1212 select interim committee is created to study and review statutes
1313 and regulations, including model laws and regulations, related to
1414 the provision of health care services in this state.
1515 (b) The committee shall convene at the call of the presiding
1616 officer.
1717 (c) The committee has all other powers and duties provided
1818 to a special or select committee by the rules of the senate,
1919 Subchapter B, Chapter 301, Government Code, and policies of the
2020 senate committee on administration.
2121 SECTION 2. INTERIM STUDY REGARDING THE PROVISION OF HEALTH
2222 CARE SERVICES. (a) The committee created by Section 1 of this Act
2323 shall study the concept of providing health insurance coverage for
2424 acute care and home health care services for Medicaid recipients in
2525 the private insurance market through a capitated or block grant
2626 funding system and, with respect to a program based on that concept
2727 or other similar program:
2828 (1) the requirements to obtain any waiver necessary to
2929 implement and administer the program;
3030 (2) the cost of implementing and administering the
3131 program;
3232 (3) the feasibility of implementing and administering
3333 a cost-sharing and sliding scale subsidy program for the Medicaid
3434 recipients served by the program;
3535 (4) the implementation and administration of health
3636 savings accounts for the Medicaid recipients served by the program;
3737 (5) minimum coverage requirements;
3838 (6) eligibility requirements, including asset test
3939 requirements;
4040 (7) options for programs to reinsure participating
4141 health benefit plan issuers; and
4242 (8) any other issue related to the feasibility,
4343 implementation, and administration of the program.
4444 (b) The committee created by Section 1 of this Act shall
4545 also study:
4646 (1) health care models and programs to address health
4747 care spending in this state related to the Medicaid program,
4848 veterans affairs, hospital districts, charity care, uncompensated
4949 care, private pay insurance, self-insurance, and other health care
5050 spending;
5151 (2) long-term and short-term models and programs with
5252 proven cost savings, including cost savings for private health care
5353 and other health care systems, criminal justice systems, child
5454 welfare systems, and other social and welfare services provided by
5555 the federal government or this state; and
5656 (3) health care models and programs that promote
5757 coordinated collaboration between local and regional communities
5858 to serve low-income and indigent individuals by providing
5959 wraparound services resulting in cost-sharing, improved outcomes,
6060 and a reduction in administrative costs.
6161 SECTION 3. TEXAS HEALTH CARE ADVISORY COUNCIL. (a) The
6262 committee established under Section 1 of this Act shall establish
6363 the Texas Health Care Advisory Council to advise the committee as
6464 requested on issues related to the subject matter under study and
6565 review in accordance with this Act.
6666 (b) The council authorized by Subsection (a) of this section
6767 is composed of a uniform number of individual members who represent
6868 the following interests:
6969 (1) the managed care organization community;
7070 (2) primary care physicians;
7171 (3) local mental health authorities;
7272 (4) hospitals;
7373 (5) mental health professionals;
7474 (6) the nursing community;
7575 (7) health care charity organizations;
7676 (8) the intellectual and developmental disability
7777 community;
7878 (9) the dental community;
7979 (10) the law enforcement community; and
8080 (11) the judicial community.
8181 (c) In addition to the members described by Subsection (b)
8282 of this section, the Texas Health Care Advisory Council must
8383 include a member appointed by the executive commissioner of the
8484 Health and Human Services Commission to represent the interests of
8585 the commission.
8686 SECTION 4. COMMITTEE FINDINGS AND RECOMMENDATIONS. (a)
8787 Not later than January 15, 2017, the committee shall report the
8888 committee's findings and recommendations to the lieutenant
8989 governor and the governor. The committee shall include in its
9090 recommendations specific statutory and regulatory changes that
9191 appear necessary from the results of the committee's study under
9292 Section 2 of this Act.
9393 (b) Not later than the 60th day after the effective date of
9494 this Act, the lieutenant governor shall appoint the members of the
9595 committee created under Section 1 of this Act.
9696 SECTION 5. ABOLITION OF COMMITTEE AND COUNCIL. The
9797 committee and the council are abolished and this Act expires
9898 January 20, 2017.
9999 SECTION 6. EFFECTIVE DATE. This Act takes effect
100100 immediately if it receives a vote of two-thirds of all the members
101101 elected to each house, as provided by Section 39, Article III, Texas
102102 Constitution. If this Act does not receive the vote necessary for
103103 immediate effect, this Act takes effect September 1, 2015.
