| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 81, Natural Resources |
|---|
| 12 | 12 | | Code, is amended by adding Section 81.010065 to read as follows: |
|---|
| 13 | 13 | | Sec. 81.010065. ADOPTION OF CERTAIN RULES; PREVIOUS RULES |
|---|
| 14 | 14 | | NULL AND VOID. (a) Notwithstanding any other provision of law, the |
|---|
| 15 | 15 | | commission may not adopt a rule that relates to the commission's |
|---|
| 16 | 16 | | ratemaking proceedings, including a rule relating to discovery |
|---|
| 17 | 17 | | limitations, alignment of parties, reimbursement of a |
|---|
| 18 | 18 | | municipality's reasonable cost of participating in ratemaking |
|---|
| 19 | 19 | | proceedings, or collection of rate case expenses from ratepayers of |
|---|
| 20 | 20 | | gas utilities, unless the rule is identical in substance to a rule |
|---|
| 21 | 21 | | that existed before January 1, 2014. |
|---|
| 22 | 22 | | (b) A rule adopted by the commission on or after January 1, |
|---|
| 23 | 23 | | 2014, and before September 1, 2015, that relates to the |
|---|
| 24 | 24 | | commission's ratemaking proceedings, including a rule relating to |
|---|
| 25 | 25 | | discovery limitations, alignment of parties, reimbursement of a |
|---|
| 26 | 26 | | municipality's reasonable cost of participating in ratemaking |
|---|
| 27 | 27 | | proceedings, or collection of rate case expenses from ratepayers of |
|---|
| 28 | 28 | | gas utilities, is null and void. |
|---|
| 29 | 29 | | (c) This section expires September 1, 2017. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect September 1, 2015. |
