66 AN ACT
77 relating to the authority of the Railroad Commission of Texas to
88 adopt certain rules related to ratemaking procedures and to the
99 status of previously adopted rules.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 81, Natural Resources
1212 Code, is amended by adding Section 81.010065 to read as follows:
1313 Sec. 81.010065. ADOPTION OF CERTAIN RULES; PREVIOUS RULES
1414 NULL AND VOID. (a) Notwithstanding any other provision of law, the
1515 commission may not adopt a rule that relates to the commission's
1616 ratemaking proceedings, including a rule relating to discovery
1717 limitations, alignment of parties, reimbursement of a
1818 municipality's reasonable cost of participating in ratemaking
1919 proceedings, or collection of rate case expenses from ratepayers of
2020 gas utilities, unless the rule is identical in substance to a rule
2121 that existed before January 1, 2014.
2222 (b) A rule adopted by the commission on or after January 1,
2323 2014, and before September 1, 2015, that relates to the
2424 commission's ratemaking proceedings, including a rule relating to
2525 discovery limitations, alignment of parties, reimbursement of a
2626 municipality's reasonable cost of participating in ratemaking
2727 proceedings, or collection of rate case expenses from ratepayers of
2828 gas utilities, is null and void.
2929 (c) This section expires September 1, 2017.
3030 SECTION 2. This Act takes effect September 1, 2015.
