55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an exemption from the veterinary licensing law for
88 certain persons who provide services to an animal shelter.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 801.004, Occupations Code, is amended to
1111 read as follows:
1212 Sec. 801.004. APPLICATION OF CHAPTER. This chapter does
1313 not apply to:
1414 (1) the treatment or care of an animal in any manner by
1515 the owner of the animal, an employee of the owner, or a designated
1616 caretaker of the animal, unless the ownership, employment, or
1717 designation is established with the intent to violate this chapter;
1818 (2) a person who performs an act prescribed by the
1919 board as an accepted livestock management practice, including:
2020 (A) castrating a male animal raised for human
2121 consumption;
2222 (B) docking or earmarking an animal raised for
2323 human consumption;
2424 (C) dehorning cattle;
2525 (D) aiding in the nonsurgical birth process of a
2626 large animal, as defined by board rule;
2727 (E) treating an animal for disease prevention
2828 with a nonprescription medicine or vaccine;
2929 (F) branding or identifying an animal in any
3030 manner;
3131 (G) artificially inseminating an animal,
3232 including training, inseminating, and compensating for services
3333 related to artificial insemination; and
3434 (H) shoeing a horse;
3535 (3) the performance of a cosmetic or production
3636 technique to reduce injury in poultry intended for human
3737 consumption;
3838 (4) the performance of a duty by a veterinarian's
3939 employee if:
4040 (A) the duty involves food production animals;
4141 (B) the duty does not involve diagnosis,
4242 prescription, or surgery;
4343 (C) the employee is under the direction and
4444 general supervision of the veterinarian; and
4545 (D) the veterinarian is responsible for the
4646 employee's performance;
4747 (5) the performance of an act by a person who is a
4848 full-time student of an accredited college of veterinary medicine
4949 if the act is performed under the direct supervision of a
5050 veterinarian;
5151 (6) a person who is:
5252 (A) an animal shelter employee who performs
5353 euthanasia in the course and scope of the person's employment if the
5454 person has successfully completed training in accordance with
5555 Chapter 829, Health and Safety Code;
5656 (B) an employee, volunteer, or agent of an animal
5757 shelter who provides nonsurgical veterinary care or treatment for
5858 the animal shelter under the authorization and general supervision
5959 of a veterinarian or under a protocol approved by a veterinarian; or
6060 (C) a veterinarian who is employed by or who
6161 contracts with an animal shelter with or without pay while the
6262 veterinarian is providing services to the animal shelter;
6363 (7) a person who is engaged in a recognized
6464 state-federal cooperative disease eradication or control program
6565 or an external parasite control program while the person is
6666 performing official duties required by the program;
6767 (8) a person who, without expectation of compensation,
6868 provides emergency care in an emergency or disaster; or
6969 (9) a consultation given to a veterinarian in this
7070 state by a person who:
7171 (A) resides in another state; and
7272 (B) is lawfully qualified to practice veterinary
7373 medicine under the laws of that state.
7474 SECTION 2. This Act takes effect September 1, 2015.
