8 | 8 | | requirements for the Employees Retirement System of Texas. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 813.101, Government Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 813.101. DETERMINATION OF REQUIRED DEPOSITS. The |
---|
13 | 13 | | retirement system shall determine in each case the amount of money |
---|
14 | 14 | | to be deposited by a member claiming credit for membership or |
---|
15 | 15 | | military service previously canceled or not previously |
---|
16 | 16 | | established, or for any other service purchase. The system may not |
---|
17 | 17 | | provide benefits based on the claimed service until the determined |
---|
18 | 18 | | amount has been fully paid. |
---|
19 | 19 | | SECTION 2. Subchapter A, Chapter 814, Government Code, is |
---|
20 | 20 | | amended by adding Section 814.0101 to read as follows: |
---|
21 | 21 | | Sec. 814.0101. EFFECT OF MEMBERSHIP TERMINATION ON |
---|
22 | 22 | | BENEFICIARY DESIGNATION. The designation of a beneficiary under |
---|
23 | 23 | | this chapter is invalidated when a person terminates membership in |
---|
24 | 24 | | the retirement system by withdrawing the person's accumulated |
---|
25 | 25 | | contributions. A person who later resumes membership after |
---|
26 | 26 | | termination must designate a beneficiary after the resumption of |
---|
27 | 27 | | membership for the designation to be effective. |
---|
28 | 28 | | SECTION 3. Section 814.401(c), Government Code, is amended |
---|
29 | 29 | | to read as follows: |
---|
30 | 30 | | (c) A benefit is payable under this section only if the |
---|
31 | 31 | | member at the time of death was: |
---|
32 | 32 | | (1) actively employed by the state; |
---|
33 | 33 | | (2) receiving workers' compensation benefits for an |
---|
34 | 34 | | injury sustained while employed by the state; or |
---|
35 | 35 | | (3) on authorized sick leave, excluding leave without |
---|
36 | 36 | | pay or leave of absence. |
---|
37 | 37 | | SECTION 4. Section 815.403(b), Government Code, is amended |
---|
38 | 38 | | to read as follows: |
---|
39 | 39 | | (b) Before December 15 [November 2] of each even-numbered |
---|
40 | 40 | | year, the retirement system shall certify to the Legislative Budget |
---|
41 | 41 | | Board and to the budget division of the governor's office for |
---|
42 | 42 | | review: |
---|
43 | 43 | | (1) an estimate of the amount necessary to pay the |
---|
44 | 44 | | state's contribution under Subsections (a)(1), (a)(2), (a)(3), and |
---|
45 | 45 | | (a)(5) for the following biennium; [and] |
---|
46 | 46 | | (2) as a separate item, an estimate of the amount |
---|
47 | 47 | | required to administer the law enforcement and custodial officer |
---|
48 | 48 | | supplemental retirement fund for the following biennium; and |
---|
49 | 49 | | (3) as required by Section 67, Article XVI, Texas |
---|
50 | 50 | | Constitution, for financing benefits on actuarially sound |
---|
51 | 51 | | principles, the amount, based on the most recent actuarial |
---|
52 | 52 | | valuation, necessary to pay the normal cost and amortize any |
---|
53 | 53 | | unfunded liability required by the period established under Section |
---|
54 | 54 | | 811.006. |
---|
55 | 55 | | SECTION 5. This Act takes effect September 1, 2015. |
